Taking action against 1&1

Discussion in 'Legal Issues' started by sholiz, Sep 23, 2007.

Some may remember a thread I started a few months back with some problems I had with 1&1.

    1&1 is shady!

Well I am considering pursuing legal action against them, I still cannot transfer my domains and they have domains that are worth a lot to other sites of mine in terms of branding.

Anyone have some advice as to what I should do?

Must be as bad as Freeparking. I have emailed, wrote and every other method to hand and they won't answer me and I cannot transfer my domains over either.

Just gone to 123reg, hope they are better, although I emailed them 5 days ago and still no reply. Seems these companys put customer service at the bottom of the pile.

Legal actions cost too much, it's cheaper to be a pain in the ass and call them several times a day.

I had a prob with 1/1 many moons ago the best way is to be to the point and firm but not rude. i owed them a lot of cash due to there fault and it took over 1 year to sort out but it did i was send them a email a day .
And if your name is on the who is then the names are yours and no body elses
so they have no right to hold the names even if you owe then money for hosting as unless your domains nead renewing.

    Good luck

Well, one thing you can do is continue trying to work with 1&1 on this issue.
Why aren't you able to transfer your domain names exactly?

If you feel you've reached your threshold, then it might be time to talk to the
lawyer. However, remember you've no guarantees.

This is why you need to select reputable providers. Reputable, doesn't always mean VERY expensive. Moniker, Stargate, Enom, OpenSRS and quite a few others have good feedback and reviews. It's always good to get a reseller account where you can have full control, including AUTH_Code , lock/unlock and much more. I hope you finally get your domain names transfered out...

Ps. you need auth_code, valid email records for WHOIS and unlocked to transfer away in most cases.

Well I was ignorant when I started.

I just checked my inbox, and noticed 10 new emails - 10 emails from 1&1 with authorization codes for all my domains.

That's the letter I sent to . Glad this may finally be resolved!

I had major issues with them close to two years back I guess. Several domains I would register would be "stalled" for 8 hours before they'd even begin to process them (although not all... only the "good" ones). Then, the same guy in Panama would suddenly register them. I wouldn't have blamed them if it weren't for the deliberate stall on domains that were seemingly hand-picked. It's more complicated than that, but anyway...

They finally took action when I let them know very plainly that I'd be filing a complaint with the state attorney general's office and looking into the registrant to see if I could find any kind of connection between them, their registrar, and 1&1 (if you're not in PA like I am, you could also threaten to report them to the FTC if applicable depending on what they did to you, but my state attorney general's office is outstanding about taking complaints seriously, even if it takes them some time... I've never reported a company to them who didn't then settle the issue very quickly after being contacted). I also let them know I'd be stopping by their offices for a face-to-face "chat" until the issue was resolved (they're practically local to me). Once I did those things, all of a sudden (within about two hours) the guy they claimed to know nothing about suddenly abandoned all of the domains they screwed around with, and they sent me confirmation emails saying they'd procured them for me.

You need to be extremely firm without being heated, and know how to go above their heads (and let them know in as much detail as possible exactly how you'll happily do that). It all comes down to knowing how to write a killer consumer complaint letter (I've never had one fail).

Wow, nice story... So all ended well in your case...

I've been having some problems with them too...

I've been through a bunch of hosts and the best I've found is godaddy.com for domain management and hostgator for hosting...

That's the combination I've been using most often, although I'm slowly moving my domains to netfirms (they've given me the least trouble, and I use three main ones right now and simply want to condense them).

1&1 used to be excellent but recently they've been truly awlful.

In the past 3 months I've been blocked from accessing my own sites with no explanation and lost domains because it took them upto 48 hours to try and register them.

My opinion at the moment is avoid them.

I dropped them when I figured out they won't let you renew the domain for more than one year. This was 2 or 3 years ago... ..
