I was thinking of starting a torrent site, i have a script and a dedicated server but dont want to risk the other sites that are on the server if this type of site is deemed illigal and i get the server gets shut down. What are your idea about this?
I don't think that they are considered illegal because they don't have any illegal content (or copyrighted content to say) on their website. I don't think they even fall even in grey area. The actual content (legal or illegal) is on a person's computer. You are just telling where exactly it lies (like search engines, which tell where is the content lies on the net).
OK I was just a little concerned when i done a little bit of domain research and did a search for the term torrent search have a look at the bottom of the page "In response to a complaint we received under the US Digital Millennium Copyright Act, we have removed 1 result(s) from this page. If you wish, you may read the DMCA complaint that caused the removal(s) at ChillingEffects.org" Never noticed that before in google, whats that all about?
Torrentspy was closed off to all US internet users. It perhaps didn't have anything to do with torrentspy doing anything illegal, they simply refused to monitor what people were using their service for. I think that is where they got into some trouble.
Torrent sites are illegal unless they are only uploading legal material. I guess there are many loopholes to get around the law, like moving servers to Canada to bypass copyright laws.
I think you could be walking into one big legal headache. The laws on bittorrent sites are murky, but if you get popular enough the RIAA and MPAA will probably come after you. Even if you can win the case, it's still not going to be a very fun experience.

thepiratebay.org was talking about buying a barge in the ocean and call it a country to get around copyright laws/issues/threats. Unless you know the law are in some 3rd world country i wouldnt chance it.
I don't understand how does the torrent sites become illegal. They don't host any illegal content, coz if the content is illegal it is hosted on some local home computer and not on the website. What is there on the site is a pointer by which that content is found and can be downloaded. Isn't it like search engines. Search engines are also pointers to some legal or illegal content. Can anybody explain how torrent site becomes illegal?

They are still providing a way for people to download copyrighted material whether they host it or not.
Search for a warez key generator on google.. you will find millions.. Then, isn't Google doing that? a way for people to download copyrighted material????
Torrent sites are a real grey legal area and very much dependent on the country they are hosted in. Renting a server is Sweden seems to be fine. No second attack on the Pirate Bay, and unlikely to be so in the future.
Well, a lot of them make millions of dollars. Check your local laws but generally speaking, linking people to copyrighted content isn't a crime.
If you choose to start a torrent site with illegal material, become an LLC. That way if you get sued you don't have that much to worry about, as they would be suing your company not you personally.
