Serious Copyright Infrigement! Someone copied my site!! URGENT

    Hey guys,

    I`m the owner and publisher of www.ps3center.net. I was looking across Google and stumbled upon http:www.ps3infor.com.

    They are an IDENTICAL copy of my site. My design and website are fully copyrighted. I believe that this is a major Copyright infrigement.

    I dont know how he got access to all my design files on my server and database? I contacted my server for that for now...

    I searches a domain whois and got the following infomation:

    Email his host and B!tch that he is stealing your design which is copyrighted they will more then likely take it down,
    Or contact a lawyer if you can afford one

    One of my good friend's father is a lawyer, I`m getting into contact with him tmr. As for now, I`ve already contacted his host... we'll see what they can do.

    Nope, absolutely nothing. I`m getting in contact with my host to see how they had access to my Database and all the design files on my server!

    Keep monitoring for content on the web. This happened to me. We removed them and within a week they were back up some where else.

    If they do it again, contact an "intelectual property attorney" before you do anything. They can help you set the owner up and nail them.

    I called his host instead. Spoke to a rep directly and they shut him down immediately. Apperently it was his 3rd warning ... 3 strikes and you're out!

    I'm actually surprised he managed to replicate the site - the CMS this runs on is notoriously difficult to skin/theme so he wouldn't have been able to just copy the source - he would have needed actual access to the files on the server; and even then, they're encoded and won't run without a license.

    Might be worth contacting Erik Hillis at customcms.net to enquire about the CCMS license - this guy can't be running that script without one, so Erik should be able to find out who he is, provide you his contact info, and more importantly deactivate his license and thus bring his site down.

    Do you have any registered copyrights? It is very important to register anything that can be copyrighted. If you have registered copyrights you can simply contact the ISP/webhost and inform them of the infringement. Under US law there is a provision that says that an ISP is not liable for infringement that they are not aware of, but if they are made aware of the infringement then they have to take reasonable steps to address the infringement or they lose the immunity.

    Even if you do not have any copyrights registered I would still try and contact the ISP/webhost. It is at least worth a shot.

    You can draft a letter that may scare the hosting company and others into action even if you don't have any registered copyrights. Notice is important and acting fast is the key!
