PayPal Chargeback?

    just turned 18 and got a credit card so bare with me if i ask a stupid question

    i hired a programmer here on DP and told him to start working on the project (hes got nice portfolio & lived in the USA like me). i paid the initial money via paypal. however he comes up with excuses such as my website got a DDOS attack, i got two jobs, and etc. he eventually got another programmer to take over the project but this new programmer doesn't seem to want to talk to me and hes barely on. i did a dispute on paypal and won of course but theres thanks to my luck he doesnt have enough funds to pay me back. i called him to respond to my email, because he wasn't online for the last two weeks, and he did with:
    now im afraid to call him and decided to call my bank for a chargeback but not sure what to say or do.

    its been two months, can i still do a chargeback? should i call the police? will this affect paypal?
    hopefully i didn't lose my money yet

    ADVICE & TIPS WOULD BE NICE

    Hi viperxx,

    Isn't frustrating hiring a programmer to complain how busy he is? Then he loses a dispute but keeps the money, and pretends he is the one supposed to be angry. Anyway, forget the loser...

    All you have to do is call your bank and tell them exactly what happened (show them the seller's quote you posted above) and they should be able to return you the funds. As the seller is avoiding you and you have received nothing. The chargeback will actually go against paypal but they can't do much as you have received nothing.

    Beside, with a credit card, you're the boss. You can even buy anything online and Ebay and anywhere else, and once you get the stuff, boom...you chargeback. You get the stuff AND the refund...really cool and it's works everytime...

    I just sold a laptop myself on Ebay. The buyer used his CC, ask for the tracking number. Once he saw it and knew the item can't go back, he called his CC Company for chargeback. Good deal: he got the laptop and the money. I lose with Ebay, I lose with Paypal, I just lose it...
    Now, I have 2 credit cards and I'm buying items on a daily basis.

    Codythebest: Credit card company's don't allow chargebacks unless the buyer can return the item. The person who filed the chargeback was probably a victum of fraud -- someone used his/her credit card fraudulently.

    If you shipped the item over seas, where credit card fraud is so prevalent, that's the risk you took...

    I completely disagree. I did experience enough transaction of all kind to stand by what I said. I also rent properties for vacation, same thing. If guest, after leaving, do a chargeback, they get their money back. And I use to fax all and every paperworks, signed invoice, everything, it doesn't work. They said someone stole their card and they're done...Easy as 1-2-3...

    i didnt ship anything, i hired someone who didnt do any work
    going to call my credit card company, hopefully something can be done

    From what I've seen being on both sides of the fence...

    You can claim a chargeback from your credit card issuing bank if you did not receive the service or item you had requested. For viperxx's case, it should not be a problem because the service delivery time could have been two months or more.

    A charge-back can only be denied if you have sent your credit card copies and a valid identification like passport or something to the seller/service provider. However in this case, the chargeback will be against Paypal.

    1) I would suggest keep following up with Paypal, give them a call, drop them reminder emails.

    2) Put in a charge-back request through your bank immediately saying that you did not get the service promosied. They might ask you to fill in some forms, attach whatever proof you have like emails, paypal receipts etc along with it.

    3) Don't bother contacting the programmer, since he will only intimidate you further.

    4) Don't think the police will help you too much on this, though if you have a cyber crime cell or something, launch a complaint with them as well. Will help the chargeback process through Paypal / Credit Card Bank.

    Just an update on what happened

    I was able to get my money back by calling my bank for a charge back. The banker called him for me (since he was going to issue a harass complaint against me) and he gave her (the banker) excuses after excuses. Luckily the banker who called him was smarter then that and she decided in my favor. Hopefully Paypal will get him back. I also filed a case with the Internet Crime Complaint Center (IC3) and I'm hoping they will take a look at him and check to see if he scammed other people as well. He's on this forum as well, so if anyone is curious about him please PM and I will give you all the info.

    I learned a very good lesson. If you pay and hire someone and within the first week he makes excuses after excuses be beware and cautious! The internet is a scary place; it's hard to find someone trustworthy.

    Wouldn't it be nice to have a report listing dead beat programmers...I've run into three and they all make excuses excuses excuses. Well yes, if you've used a credit card, then yes, you can do a chargeback. Unfortunately the seller will be charged a $10 fee.

    I don't support chargebacks usually since there are honest sellers out there, but in the case you should do it. Hope you get your money back.
