    A sensitive issue such as this, you need all the expertise you can get. This is no 4 year old kid taking candies from the store issue. This is far more serious because one's life is at stake. Here is an answer from a scholar:

    M5Love - a woman was raped. Do you not realize how ludicrous the stand you are holding to sounds, at least to this set of ears? Because the punishment is severe, the woman will require 4 male witnesses? And if it were a lesser punishment, a "discretionary" punishment, scientific evidence - the very stuff used in our court system to prove or disprove that a rape took place, as a matter of course, and not because the potential punishment may or may not be "severe" - then, and only then, the scientific evidence, or other objective methods, can be used? Why? I would ask, especially given the severity of the punishment - why not use scientific evidence? If the accused were innocent, why wouldn't you want scientific evidence to aid his case?

    Further, let me toss a hypothetical.

    So, a woman is being raped. If the 4 witnesses are "sympathetic" to the woman, why would they not stop it? If they are not sympathetic, such as has been repeated, apparently, ad infinitum, why would they verify the victim's account? And, if this is the case, is the woman, or is the woman not, punished as an adulteress? Yes or no?

    Sad. These women are your mothers, daughters, children. A growing sense, from the things I have seen, and heard, from the mouths of Muslims such as yourself, demand I ask: why are they being treated little better than cattle?

    M5Love - you have laid out facts - I am disputing you on the facts you yourself have provided. Here, let me refresh your memory, from the facts you already posited, from a "scholar":

    I have not contested anything except by basis of looking to those facts. Please do not on the one hand toss out an opinion, from a supposed authority, then refuse to discuss once those opinions are dealt with by myself, or anyone else who might have a problem with the mindset that generates such philosophy.

    Look, M5Love, you began by saying it is applied, but because "this isn't a kid stealing candy," the severity of the punishment merits the "4 person" squad, I infer, from your posting of the scholar's material. Then, you said it isn't applied - it's all a myth. Which is it?

    One more time, buddy, to help refresh your memory of your own post. Did your expert say, or did he not say:

    "Rather," meaning, what follows is the deal, is the truth, is what takes place; "applies," as in, well, applies. Is applied to. Is made applicable. In other words, it applies, in certain circumstances.

    Again I ask - why is such a thing in existence at all? Why not deal with what I said - why wouldn't scientific, medical evidence be applied across the board - rather than the word of some assembly of non-parties to the alleged crime?

    I won't reply again, since this is such an obvious question, to me, that it requires no deep inquiry to answer.

    Like he said, it's applied in very rare cases.

    I am not that knowledgeable in Islamic law to tell you why scientific evidence is not sufficient. I will find out, not for you but for my own understanding.

    I myself am not blaming a religion for such deeds. I am questioning why a woman subjected to such evil isn't more properly taken care once such deeds have taken place.

    I think it has to do with the high value placed on virginity of women since from what I can tell there are none above the age of 9 in some areas.

    So if she allowed herself to be raped - losing the only value she had - then she should be punished for the crime of irresponsibility.

    Just a guess...

    There are several similar cases of rape going on in the world. They are really horrible. I'm not a muslim, but I feel it is absolute injust to pick this incident just for blaming the relegion.

    For 2 individuals one should not blame Muslims. Open newspaper, everyday, at least one news of rape you would see in these newspapers , OBVIOUSLY not committed by ONLY MUSLIMS.

    it requires too much dependance on experts testimony

    When we are dealing death penalty (in case of the married adulteror/adulteress) or painful physical punishment (in case of the unmarried), we require certainity. In the absence of certainity the hudood class of punishments cannot be given, however the judge may give a lesser sentence based on circumstantial evidence,
