He still gets loads of traffic, so I don't think that it is hurting him. Also, you don't know what he has on his .htaccess file. He may be telling bots to ignore some of the duplicate pages.
What about the test he was running and using anchor text to his site "make money online" that he made oh so public to everyone. He proved there was a flaw in the google system by doing that test and generated a ton of traffic for doing so. Now that he is banned, he still gets a ton of traffic, he markets himself very well and by being banned he isn't hurting all that much now from the result.

he was bitchslapped by google for trying to beat their algorithm. If you intend to do anything of link karma, heh, do it under the radar of the big brother.

All the pages I found were indexed in Google so his isn't blocking them. Any dup content will harm a site. Sometimes it doesn't do much harm, sometimes it does. I'm not saying the dup content caused his penalty but its worth him fixing it just in case.
