    It depends.. If they were both for the same host then no, but if some other party copied it then yeah

    well its a contest and they were both for the same person...mine was entered first and soon afterwards the similar version, inst it infringement on my rights as owner of the original design?

    It could be but there is not much you can do about it. I am not sure if a logo for a contest can be copyrighted but it is up to the contest operator rather he will accept the other person's logo as original.

    What's really an infringement is havint 700+ posts and starting a thread in the wrong section because copyright has nothing to do with COPYWRITING, the art of writing the verbal elements of an advertisement.

    It doesn't matter. Post it in legal if you want. You'll still get the same BS, no experience in law, answers. :)

    First thing you need to do is read the contest terms to make sure your creations weren't "opened" up to others for the sake of the contest.

    Of course, this only matters if that person one or if they are using it in a business setting. If not, there's no reason to pursue the matter, because nothing came out of it and the offending party probably has no real assets.

    Ok, I see what you mean, i was always under the impression that the designer of whatever, owns a copyright to that design. Are you sayin copyrights laws are only active when the design is sold.

    Does this mean another designer can submit my proposed design or similar (if the contest rules do not specify otherwise)

    I dont plan on pursuing the matter anyway, i just want to understand a little better.

    No, that's not what I mean. Copyright IS setup on creation. And you do own it. Remember, copyright is a BUNDLE of rights.

    I was just telling you to read the contest rules to make sure there wasn't some rule about how, by submitting, you're allowing others to build derivatives of your work for the sake of the contest.

    I'm sure there isn't and this person is just a thief. Contact the contest holder and tell them, so this person gets thrown out.

    I couldn't do that, there was no real harm done other then the person who copied it denying the similarities, neither entry even won, i just thought it was bad ethics on the behalf of the other person, to try and say they were not even similar. I would have apologized and removed my entry, even if it was coincidence. Anyways, thanks a lot for the insight, you've been a great help.

    A. Yes, it's infringement. I don't think any reasonable person would fail to see the obvious resemblance.

    B. Neither logo looks good. Especially the first one, but ESPECIALLY the second one. No offense to you if you are the designer of one of them.
