Please can someone explain who the "individual" is in regards to this NDA. WEBSITE.COM NON-DISCLOSURE AGREEMENT (STANDARD RECIPROCAL) THIS AGREEMENT (the "Agreement") is made between WEBSITE.COM, ___________________________ ("individual") and entered into this ______ day of ________________, 20_____. Is the "individual" the name of the person who sent the NDA out (website owner) or is it the recipient of the contract?
and entered into this ______ day of ________________, 20_____. Is the area for 'day' the actual day of the week or the date?
I should end up looking something like this. There was a key "AND" missing, which I added. Without that it did not make sense. THIS AGREEMENT (the "Agreement") is made between WEBSITE.COM ("Website") AND __person's name______ ("Individual") and entered into this __20th____ day of _______July_________, 2007.
Thanks, I've changed it to this now anyway: THIS AGREEMENT (the "Agreement") made and entered into this ___ day of _________, 20__ by and between WEBSITE.COM and _____________________________ ("individual").
It is simply how the 2nd party will be referred to else where in the document (though as above the word and is missing). It will later on say Website.com and the individual agree to.... etc - normal practice again would have had it as "The Individual"
A better practive would usually take the form of: where 'the individual' would usually be more descriptive (like 'the buyer' etc) Just 'company' and 'individual' are greatly diluted forms of the same thing, and a bit unprofessional IMHO!
