    contact Hostgator and ask them to buy the domain from you. There is a good chance they will just do it...

    They could just seize it, under a trademark issue of course. the domain is exactly their company name. Don't contact them to sell it, because they might think its blackmail/bribery. You could park it with affiliate links to host, or develop it with hostgator reviews. Having the domain opens you up to legal threats, and so does selling it as they can charge that yu bought the domain with malicious intent to profit on their trademark

    Maybe not, court costs a lot of money, they can't just 'seize it' (for free) when buying it works out better for everyone.

    IMO, your advice is good for a bigger issue ($XX,XXX.xx)
    This domain ($xx.xx) is worth a friendly email to Hostgator.

    Court costs a lot of money, but ICANN doesn't
    You can file directly with ICANN over a traademark dispute issue, no courts involved. Which is the most likely action. To the domain owner: sorry for being so negative. What I've oulined probably won't happen, but at least someone warned you. Keep the possibility in the back of your head
    And if hostgator won, the domain owner would probably be required to pay its legal fees, just as if the owner won, hostgator would pay his legal fees.

    well you were partially right. US court takes only claims of $20 or more. And the domain registration is about 9 bucks. So a rep to you. Nice learning something for a change

    if dont ask for a huge amount of money then I would say they wont go through legal action with you... I would almost be positive that they would rather pay you $100 then taking you to court and all this other crap....
