    Hello,

I have a SMS related website, with free sms, chat, etc
I want to add ringtones function, just like jamster, dadamobile, etc
I have my own billing system, where i charge users using sms.

I've been looking around and it has been pretty difficult to find companies who can sell me ringtones. of course i really want to buy it, because i want it to be 100% legal...
I have about 250.000 ringtones in my server, but i don't have any license for selling them.

Can anyone help me out ?

Why not just use affiliate program for them. You can sell them and make money per sale and no need for license the company has it.

As i told, i don't want to be an affiliate. I have other websites where i'm affiliate of jamster, dadamobile, etc

In this SMS website i own, I earn up to $6 per member, each week, recurring. I have my own billing system, which is reverse billing (i get $2 per each sms user receives).
I just want to give my members possibility of uploading ringtones, games, etc into their mobile phones.

    Thanks

It has been a while, however if I remember right under music copyright you can cut up to 30 sec of audio from a song or sound clip and sell it without any trouble. This law was set in place for the radio stations to use clips from tracks for commercials, and them funny sounds you here when the DJ is talking.

However you will want to research it some to see if that law has changed since 6 years ago.

You could also talk to some of the cellphone moguls to find out if they have any information on it, I think their is a couple on this forum.

That sounds 100% untrue to me. I do not think you have any right to clip 30 seconds of music and sell it. I don't think that was ever the law.

Im right and wrong at the same time. ;p

"For academic purposes other than performance, multiple copies of excerpts of works may be made, provided that the excerpts do not comprise a part of the whole which would constitute a performable unit such as a section, movement or aria but in no case more than 10% of the whole work. The number of copies shall not exceed one copy per pupil." ref: http://www.menc.org/information/copyright/copyr.html#appendixb

I was wrong about commercial use, the 10% or 30 sec law is only for academic purposes. Thus why I said do some research!

You will need to contact a label and find out about paying royalties to them for downloads, or higher someone to make other sounds and tracks that have been published by another artist.

Nothing in that section would allow the use by a radio station or selling of ringtones.

Those were the topics. Yes, the copyright provision allows the limited use of copyright materials in an academic setting and then, only for very limited purposes.

For all intents and purposes, your information/advice/opinion was 100% wrong. Radio cannot use it, cannot clip 30 seconds, and most importantly to the original poster - he can't use any of for sale as ringtones.

Thanks for posting the source of your information though.

Again, you cannot simply record your own version of a published song and then sell it. You would need to license it though ASCAP. When you hear people singing a song on TV or in a Movie, even on the radio in a show, they have licensed the rights. You simply can't use people's published works without permission - the only real exeception being fair use. And that would not really apply here to his ringtone issue.
