rackedspace.com is this illegal to run hosting?

    Hi i just purchased this domain name i didnt know it was free.

    well i am planing to run it as a hosting company.

    will this be any conflict with rackspace.com?

    i dont have anything to do with that company i just want to know if its ok to do so?

    There certainly could be trademark problems. Any trouble would be them deciding its worth their time to get you to take your site down.

    Mentioning rackspace on your site in any kind of comparison would be a quick way to GET into trouble.

    If you were using it as a non hosting company your chances of getting into trouble would be lower.

    The best thing to do would be to ask them, then you would have written permission from them.

    I do n't see any tradematk problems as your domain rackedspace.com is different from rackspace

    But if your are going to start a hosting company then you should always advertise your hosting as rackedspace solutions and not as raackspace


    But it is always better to consult an lawyer!

    I would not ask their permission. Make sure your logo and trademark are not similar and go about your business.

    Hi i just chatted with them and they told me that i need to call them tomorow.

    Because the person that i chatted with wasnt sure on what to do.

    i am going to email them and then see what happens.

    How do i get advice from a laywer or contact with a lawyer?

    If someone could confuse you for rackspace.com then there is infringement, though I am not a lawyer. You NEED to consult a lawyer. Never advertise as rackspace and do not have a similar logo and website is a great starting point.

    Thanks for the advice,yes i know i not even going to be thinking about rackspace stuff.

    Site/logo everything will be different.

    anyways i emailed them i waiting to see what they would say.

    I can almost guarantee that rackspace will say no, because they hold their brand so closely. There is no US trademark for "racked space" or "rackedspace". No matter what rackspace says, you NEED to consult a lawyer. If your in the US, you can get free business advice from SCORE.

    Short and sweet ...Get a new name!

    I have been playing the name game for a while and quite honestly if it was an amazing name, I would say maybe roll the dice ...But it's not.

    My personal opinion is that if you create a hosting company on this name... you will lose the name. RackSpace has plenty of lawyers at their disposal ...even for "minor" things.

    There are plenty of names that are available on the open & after market that will not cause any sort of conflict.

    You might get into legal tangles ... although I feel the chances are low ... Just chuck the domain and go for a new one with some creativity ... Thats all it takes ...
