Using a non legal Template Design.

    Hello ,
    I have a client with a company in Israel , and I'm from Israel too.
    I want to know if it possible for me to use a template (from templatemonster.com) that I have downloaded from a sharing forum without any danger of getting sued ?

    P.S. The template is not new , but still on sale on templatemonster.com

    I just want to know what are the risks if I use this template without buying it directly from templatemonster.com ?

    i dont think you should do that..its not ethical..authors work for it on TM..

    that said, i doubt they'd have a Call Home on their TM's, they are just HTML's and theres no License etc..

    dunno much though..

    It is stealing! Plain and simple. It is theft. Theft is illegal.

    How would you feel if someone stole from you? It does not matter who you are stealing from, it's stealing.

    I appreciate the work but don't have money for that , can I take the risk ( I can always say that I find it on net and didn't know its illegal ) , correct my if I wrong .

    What reply are you expecting? Do you want us to tell you that what you are doing is OK? It's not. It is illegal.

    Should I steal your car because I don't have the money to buy my own?

    Not worth it, it is taken very seriously and could result in a few damages.

    Okay as everyone has said, yes it is stealing, and very unethical. Especially if the site is to make money off it, it would be better to pay for the template.

    Realistically, you arent likely to get caught, however if you must decide to steal the template instead of buying it, atleast once the website has made profit, pay for the template after - its only fair.

    I doubt that you will get in any trouble.

    But personally myself and other members on DP would advise you NOT to use downloaded templates without actually paying for them, this is obviously stealing, this is ethically, morally and legally wrong. Though you may not see the consequences of your actions, you will eventually be caught.

    Note: by you making this thread, you will now be seen as a person of no integrity and which has no respect for the work of others, this will affect your image here which may limit your ability to do business with other members.

    I would advise you NOT to use stolen templates for your own sake.
    C'mon man, its only $50-60.

    obviously if they are your client, they are paying you to complete the job, so you should be costing that into your charge. So to say that it alot of money for you is not a good response, just because you want to take the easy route and not pay to create a design yourself.

    here is an example of what happens when you get caught:

    About 5 years ago i did a site for a client, my designer creates a small flash banner rotating some images (tiny thumbnails). a couple of months ago they was issues with a law suit from Getty Images claiming that 1 of the 8 rotating images used belonged to them and we did not have a licence for it. After us seeking legal advice we ended up having to pay them £1500 ($2850)

    So take the chance if you want, but if you get caught be prepared to pay the consequences!!!!!!

    If you dont have the money to pay for it then create it yourself.

    You would need to look at the legal relationships across Israel and the USA to see how likely it is that a court order in the USA would be enforced in Israel. The sums involved suggest that it isnt worth a company pursuing it but then many companies will simply because they become a walk over if they dont/ to make an example of people.

    Need to also look at the USA legal system too as you will probably not only be liable for the losses but also for the costs involved in enforcing the ruling so the high costs involved in international legal action gets passed to you too (though in the UK only parts of the costs are passed across depending on the level of the claim)
