i was wondering how do search engines justify who the original creator of the content and who isnt? who gets punished and how.

i dont think you actually get a penalty, i think they just dont index it/put it in supplemental

    im probably wrong though

I think the same way with fastman. But if you have too many supplemental results, your ranks can be punished by google in their SERPs.

the person with the highest PR usually wins. Doesn't matter who the creator is.

Hmmm.. Doesn't the date of the first index count as well?

I read an article about some kind of experiment, do not remember where.

Anyway, some guy wrote an article and post it on his site. Waited for a about week to get this article indexed and linked.

After that he sent it to EZineArticles, within few days/weeks (do not remember exactly) when he searched Google with his article title, number one result was from ... yes you are right EzineArticles.

So i gues like was already said before the one with higher PR wins.

it does, but if the creator has very low link and the person who copy has more link. The one with more link gets higher. At lease thats what I believe, and from experince I have seen.

Does this mean that every time you change any content on your site, you have to submit it to Google?
