It varies per country, jurisdiction and more. If you want a more practical problem, start spamming 500K emails a day. Then you attract attention. You'll have problems that won't even deal with law but with policies at other ISPs, providers, etc. perhaps even your own.

In simple terms, Email marketing is spam. There has never been a time when spam was welcomed by email users. The first attempt to market via email -- in the days prior to the www -- generated user complaints and the company involved decided they would never again use that method of marketing. While sales were generated, it was deemed the long term cost was greater than the short term benefit.

If you want to market a product which is available via the internet, there are a myriad of methods available to you. Venues such as eBay and Amazon allow you to sell legitimate products directly to end users. Putting your product website in your signature and making helpful posts at forums likely to be visited by potential customers helps generate traffic. Products such as AdWords allow you to create geo-targetted advertising campaigns, which brings a few more people to you. If the product is real, I would back it up with offline advertising. Look for a newspaper in your area of interest with a really fat classifieds section and put something in there. Banner ads do not attract traffic but they create brand/product recognition, which is helpful over the long term.

Even so, marketing is 24/7/365 and is takes a lot of effort and time to have success.

The only 'spamming' i would say should be allowed is opt-in lists.

Even so, if this is overused then the person operating it imho should be banned. You must build a client base for yourself - not buy a list.

A person will go to jail because of spam. It is neither legal nor ethical.

I disagree with your disagreement :p

e-mail marketing IMHO is just a posh word for spam, ok so there may be the occaisional exceptions but 85% of the time it's just pointless spam.

Yup. Spamming sounds bad indeed. E-mail marketing is not consider as a spam as long as they don't send you multiple email at the same time. :D

I figure that any emails that I send in a marketing attempt will be for people that have specifically asked me to do so and will provide a way for them to let me know when they aren't interested any more. That avoids the technical problems with spam. If I manage to craft those emails in such a way as the person is eager to read it then it gets rid of the literal problems with spam.
