Scammed by a SitePoint user

    I sold two domain names (NameClown.com and BongBuilding.com) to sitepoint user "gent07" in the month of April. I come home after a great day at the office to find that Paypal has taken the money out of my account because this FUCKING JACKASS went to his credit card company and told them that he didn't make these payments. So here I am, short 2 domains, short $110... and I've talked to everybody I can. Paypal... namecheap... godadd... icann.. NOTHING.

    I've called the phone number in the whois and it doesn't connect. I've done a bit of research on the address and it all seems phony balogna. Not to mention the fact that the whois info is a womans name and the paypal account is a mans name, DIFFERENT LAST NAMES. The worst part of it all is this fucking cunt lives in England and I'm all the way accross the pond in Canada.

    So what do I do now? How can the world be full of such injustice? Apparently because it's intangible goods, I'm not eligible for seller protection. This is bullshit. The registrars won't even help me by giving them evidence that the domain names were transferred from my account to his, on a certain date. I'm sure that's all it would take. But NO they won't budge.

    I am so frustrated. I've been doing business over the internet for years and this is the first time I've ever encountered a problem like this. GoDaddy told me to get a lawyer. A LAWYER? I'm 17 years old! And plus it's over $110... the lawyers would surely cost more than I could possibly stand to make back.

    What are my options, if any?

    Apart from pestering the registrar for the details there isn't much else you can do. Im not sure if its the same in Canada, but you could take them to the 'Small Court Of Claims' I think its called and that is a small court for claims as it says. A buisness related court.

    Im not too good with this legal stuff to be honest.

    Haha yeah a bit. I'm sure it would be "Court of Small Claims" not "Small Court of Claims". I could be wrong though. There could be a really tiny court somewhere that regular claims are held in. :p

    Yes, small claims court will take the claim for a small fee but good luck in getting the money. They don't make them pay, its sometimes a win or no win situation. Its been 3 yrs since I made a claim and still waiting for my $2300.:eek:

    I would say your best bet is to contact the user saying that you will take him to small claims court if he didn't comply to your requests.

    I agree with PoohBear88. Contact the idiot if you can, and say you will take charges again him. Give him a certain amount of time before doing so. What annoys me, is why do people that kind of thing these days? Its just stupid

    Makes me mad, all these scamming tricks.
    Tell me, do you have any solid proof that he bought these 2 domains and actually PAID the sum of money ? if you do, and you have the nerves and patience to go to court, then do so.

    Complain to his registrar that he is using fake data on his Whois. He may lose the domains.

    Other than that, there really isn't much you can do. Court is a waste of time considering the $ involved and the fact that you won't see a dime of the money even if you do win.

    Yes, you could try to do things like that (also complain to his hosting company if he tries to put sites up) to keep him from getting anywhere. I saw on thread on here or SP where Godaddy confiscated a domain due to a bad contact email address without giving the registrant much time to fix the problem.

    The only problem is, there's the potential that this dude will then sue you for harassment and/or libel or defamation of character. (Or maybe that's only in the US, where house robbers can sue the home owner if they get hurt during the robbery!)

    that would be my suggestion. i think its illegal to put false information on the whois, it'll be against their TOS anyway.

    As crappy as this is you learned a valuable lesson. The best thing you can do is just move forward and the next time dont do business with someone unless you know more about them.

    Well, this is what I have been told is the best way to not get scammed:

    Once they paypal you the money, tell them to open a dispute, and then immediately close it. That will prevent them from opening another dispute. Most of the time, if the people are legit, they will have no problems in doing so.

    One thing they suggested was send an envelope and get the tracking information for it. That way I am eligible for seller protection.

    Contact their ISP and tell them that the owner of those domains are in possession of stolen material and/or your copyright. Get them shut down.

    Contact the sitepoint admins and inform them of the name of the scammer. Block that user ID from posting ever again.

    Don't give up until your bootheel is on their throat and squeezing.

    contacting the mods at sitepoint doesn't do anything. I went through this not long ago for $1000.00

    If one of the domains was at godaddy and it is within the 15 day period since it changed accounts (did you transfer it to an account of his at godaddy?), then pm me. I might be able to give you advice on how to get it back. I did it once for me and it worked. Criteria: Has to have been within 15 days, transfered to another godaddy account.
