Black hats exploit possibilities in the SE systems to get their results high up in the search results.

Generally black hat techniques are things that are done only to be seen by a search engine, not for the visitor to the site, or are designed to 'trick' a visitor into looking at a site. They're not 'illegal' - it's not (usually) like hacking, you won't end up in court for using such techniques - but they are contrary to the terms and condtions of the major search engines and you can be penalised

It actually has nothing to do with legalities, I am sure the search engines would want to make people think that it is illegal to practice Black Hat techniques. Black Hat SEO can get you banned in the search engines, but there is nothing illegal about trying to beat the search engines, it is a moral issue. White Hat techniques is considered ethical while Black Hat techniques are considered unethical. Gray Hat techniques sway either way, some believe Gray Hat is ethical while others think it is unethical, it plays the fence and is borderline for the most part. Gray Hat usually use Black Hat techniques in an ethical way, such as cloaked pages, but for the inteneded use, redirecting search engine bots to an optimized page for robots and redirecting web visitors to a web user page while focusing on relevancy. I personally prefer White Hat techniques, as I feel it brings more value to your website and its good practice.
