Ok I have had people post advertising comments on my profile, like to buy stuff etc. I can delete the comments. But i'm just wondering,is it legal to comment like this on people's myspace profile?

Of course it's legal. It may be against MySpace's terms though.

Worst thing that can happen is they ban your account. Unless you've hijacked like a hundred thousand accounts, or programmed a bot, I wouldn't worry.

I heard Tom is starting to sue spammers? So I'm not sure if it's legal :p especially since this is direct advertising! And unwanted..

From what I've read MySpace has only sued people people who have phished tens of thousands of accounts, and even then the info is shaky. The only lawsuit I know of for sure was for two people who tried to extort MySpace.
