Newsletters are fine if they signed up for it however. Generally, if you send emails to the right target audience, it would convert much better. The best email marketing would be through newsletters since they sign up for it and will actually read the email.

I do email marketing campaigns every 2 months at work (this company wants to continue doing it). Personally, I think it's near-worthless. The response is so minuscule that there's no real benefit, usually less than 10% of the emails even get opened. I think PPC ads are much more advantageous, at least from my experiences.
If only 10% of your list is opening your emails and clicking through - then A) you do not have a good email list B) it is a purchased list C) you are not effectively capturing site member/customer data
Email marketing is legal if the people on the list have opted to receive emails and can ask to be removed.

it's a good way to keep in touch with your customer list - to make repeat customers out of people who have bought from you once.
Depends where yuo got the emails in your database. If the person who receives it can't instantly recognise who you are and remember how you got their email, then there is a chance they'll report you as SPAM. Perception is everything. Even if they did opt in to receive your email, unless you clearly state who the email is from and how you got it, confusion may arise. You should be able to prove this, hence the birth of double opt-in emails subscriptions.
We have used constant contact a bit and it's been very good. The hard part is devoting the time to send out a good newsletter each month. For small lists this is a very economical service. My recomendation would be to plan out your email campaign for your first 4-6 mailings...this way you know what your getting yourself into!
If people join a membership to your forum and check off an agreement that their email can be shared.. this would be another legal way.

Even though the thread-starter is now banned, I will still add my two cents: Email marketing is legal, however like tradeya has stated above me there are alot of rules you must follow, to be "CAN-SPAM". I know there are alot of people who disagree with me on this, but you have to go big if you want to get started. You need a really strong platform, somthing like Celibero or Automatic Interactive. You can't really have anything just running off your computer if you going to be sending out 5-20 million emails daily. You need a large server, and maybe somthing with a 5mb burstable line. It costs alot of money to get into, and data is really important. You have to have GOOD quality data. Nothing like "250 million emails for $99". For one, that list is prolly 100% automatically generated, or collected illegally. 2nd, it will get you no where, and most likely into trouble. Right now, I'm pretty sure you can get data for somewhere around $500 per million, or $0.10 each. That way you know it is legit, and the people actually subscribed. Automatic Interactive is perfect for anyone looking to get started. I was going to go with them but could not muster up the money(or the courage) to get into the game that big. They will let you test out their system for somthing like $1500, and that includes a 1 million email blast. Automatic is also cool because you only pay for delivered. Say somthing does not make it through a filter, then you don't pay for that email. the link is automaticinteractive.com. Also, you have to have a valid unsubscribe link, and if your promoting through affiliate companies you must use the supression list. It can be very profitable, just you have to know the right people, and get all the right tools before you begin.
