Are movie trailers copyrighted?

    Does anyone know if there any restrictions regarding the use of movie trailers on pages about that particular movie?
    Also, am I safer embedding a movie trailer from YouTube for examples, or hosting it on my own server?

    Of course they're copyrighted.

    If it safer to just get the videos off youtubes.. since most sites do this. Don't host it in your own server.. just to stay safe.

    Ya man - of course they're copyrighted. The movie companies have enough legal and financial clout to kick up a fuss too if they want!

    Yes they are copyrighted but you can link to them. Doesn't that solve the problem without worrying about breaking copyright laws?

    I guess didn't quite phrase my question very well, was just wondering whether using a movie trailer on a website which essentially promotes the movie would fall under fair use. I will stick to embedding the youtube videos - seems to be the safest option.

    No, I doubt it would be fair use but to be safe, contact the movie studio and ask them about using their clips.

    I know the local Cinemas' website will do a review of the shows and provide a link directly to the Film's Studio website for the video clips.

    So if the cinema chains cannot host the promotional video clips on their site, I would think that the rest of us would not have better luck

    They are copyrighted, and so are the background music that are played in them too. Otherwise people would rip their songs, clips, etc.

    You bet they are copyrighted. But these were made to promote the movie and if you use them to do the same you're more then welcome. What a fool would have a problem with people doing the promotion for them for free?? They should treat you very well!

    Did someone make it? Then it has a copyright.

    That's an easy test to do.

    Whether or not some parts of the copyright have been extended to others and the manner in which they were extended is another matter.

    I'm not a lawyer, but I do believe that showing a YouTube item on your site (that infringes on someone's copyright) can get you into trouble.

    Why?

    YouTube doesn't give users (like you) a waiver of liability and you're responsible for your own property.

    While I doubt any company would go through the trouble, because they can just hit the source, it is something to keep in the back of your mind.
