    Today I enter my digg profile and saw this ad (ads by google)

    Mario Smith Blog
    Enjoy reading articles on my site Also check out
    the ads !
    tudsy.blogspot.com

    I think It is against TOS but google accept it...

    You mean you actually saw those words in an 'Ads by Google' ad unit? If they were in the ad itself I suppose AdWords must have accepted it.

    If it's anywhere else on the page then it isn't allowed.

    Just under header, Digg has Adsense ads..

    I don't know whats the problem here?

    @twin: so this dude Mario Smith (a.k.a. tudsy) advertised his blog with those exact words using AdWords.

    The quick answer - it is not illegal for him to advertise this way. However, if he said those exact words on his blog then it'd violate the AdSense TOS.

    In this instance, he's using a loophole to his advantage.
