Where are the mods/admins?

    I have found this post:

    He is clearly selling template monsters templates.

    I have tried to find an admin or mod to remove them but there isn't any.

    So I have gave a link to template monster which will now have repercussions for DP because template monster will also come down on the owner/owners fro allowing it to go on (same thing almost happened at sitepoint but they managed to remove them just in time).

    Mods do not get involved in that

    Here is the Mod list.

    They don't get involved though, Its not for them to decide what is legal and what is not :)

    sitepoint almost got screwed over because they where 'allowing' the copy write infringement to go on.

    Think its well with in there means to decide before they get it in the neck.

    Shawn ( Forum Owner ) complies with all law enforcement agency's

    But , I think there needs to be a court order before he will get involved

    The reason for this is because 'Digital Point" is not a law enforcement agency, a court, or a judge

    Therefore "Digital Point" is not granted, licensed , or does not have the means to decide "who's is who's"

    The original creator would have to get a court order to remove the post

    Not the case, take a look at P2P networks and sites.

    They are the ones that go to court for what people post/share using there sites/networks.

    If you don't pull the trigger but you still hide the body your just as guilty.

    I can't speak for digital point any further then what I have said, but I think this doesn't apply to forums.

    The laws apply to everyone within its boundary's, that includes forums and yes it is the owners that get the rack for it.

    take a look at the people who owned napstar they weren't the ones sharing the copy written material but they got the rack for it.

    Aiding and abetting is a crime and like it or not the legal material is on DP servers or being distributed via DP servers.

    I'm no expert but what I have seen its very much the owners responsibility no matter how much they say it isn't "we are not responsible for what our users post etc etc"

    But in truth they because its on there servers/there servers being used to share/spread the information about the copy written material.

    If it ever went to court (highly doubt it would but in theory) the owner would have a hard time explaing why he allowed the sharing of copy written material to happen on his servers.

    Most hosting company's do not even allow links to sites with copy written material as it can fall back on them because the links are being provided on there/by there servers.

    Just something to think about.

    Ok - question....

    How would the "site owner" or "server owner" in your eyes know what is stolen or what is copyrighted.

    There is a law, I not sure where I read it BUT, it does say that USERS, are responsible for there own posts.

    There was an issue with this with the VB software itself a while back, VB was concerned about hate, porn and violence being promoted with there software and they were going to pull licenses.

    Bottom line

    Until the forum admin is contacted, to let them know that the stuff in question is stolen or copyrighted , HOW are they supposed to know?

    When I mean contacted , I mean by the "owner" of the product.

    Otherwise its just "he said / she said"

    Unless you are the owner,.......

    The mods have been in and out of that thread.. trust me, they do their jobs! Template monster really has no way of knowing unless someone reports the issue or they have a special team to search through illegal templates... this issue has been taken care of...;) :) :D
