Yes, I agree. You can't modify the script because its against TOS but if its placed in a site with content.. it should be fine.

Doesn't that draw attention to the ads which is against the adsense TOS?

i do not and will not modify the script just put google script in the the floating script table. and it will show google ads instead of picture or text only. so is it still ok?

    ok i found this info

    Hello,

While reviewing your account, we noticed that you are currently displaying
Google ads in a manner that is not compliant with our policies. For instance, we
found violations of AdSense policies on pages such as
    http://www.nadzrulsystem.com/.

Publishers are not permitted to encourage users to click on Google ads or bring
excessive attention to ad units. For example, your site cannot contain phrases
such as "click the ads," "support our sponsors," "visit these recommended
links," or other similar language that could apply to the Google ads on your
site. Publishers may not use arrows or other symbols to direct attention to the
ads on their sites, and publishers may not label the Google ads with text other
    than "sponsored links" or "advertisements."

As a result, we have disabled ad serving to the site.

Your AdSense account remains active. However, we strongly suggest that you take
the time to review our program policies (https://www.google.com/adsense/policies
) to ensure that all of your remaining pages are in compliance.

Please note that we may disable your account if further violations are found in
    the future.

    Sincerely,

    The Google AdSense Team

So i think that's end of my question.!!!

thanks everybody for your reply. ^^

Umm but after read it carefully (again  ) Those wil just apply to the case that you direct people to click it. However, this script will not show any words like that it will show only the google links or referal banners to click.

make it easy this script is more like a frame windows that the right frame keep still when you scrolling the left frame down.

I do not have to modify google script just put it in another script to keep it show up.

so is it still possible to use?

I saw this very thing on a site yesterday (sorry, no clue which one) and thought it was the coolest thing. I scrolled up and down for about a minute playing with the google ads as they bounced from top to bottom.

As for whether or not it's allowed though you may want to ignore our answers and go straight to the source (google) as they have one line in that letter above which may make such a thing against the ToS.

Publishers are not permitted to encourage users to click on Google ads or bring excessive attention to ad units.

Like I said I played with the ads, so that was more attention I've given to ads in likely years.

If you find an official answer, please let us know

This is NOT allowed...I've already asked them this and got a response directly from Google which was a pretty resounding no, it alters the delivery of the ads.
