It's very hard to establish who ripped who off. And secondly, the content might be in the public domain as in free and with no copyright. If the first guy is really making good money from his cloned site then kudos to him - building up traffic to duplicate content is always difficult.

Strictly speaking, Adsense cannot be placed on pages with copyrighted material.
