Trademark...

    I was looking on the gov website for US. I noticed that, there is a ceartain word that has yet to be trademarked. But is highly used.. I mean used a lot to lol. If I trademark this name, could I shift it to were I could possibly make money off the people who are currently using it?. I mean the only people that use this word is huge corporations usualy. Its used a lot 2...

    All help is appreciated

    You can search through the various number of other posts that deal with the question, but the quick answer is no, you have to have been the first one to use the term, in one of the 40 some trademark classifications. Unlike patent law, its first to use, not first to file. You also don't need to file for a trademark to establish your rights to the term. Searching the USPTO is only the first step.
