Sending Bulk email

I'm working with a racing website and we want to mail about 1000 tracks and offer them a partnership.

Just wondering what are the legal implications.

The emails are sourced from industry directories, and the tracks own sites.

The company is reputable and well known within the niche. The emails will be addressed to the right people within the companies.

If we can't email them legally we would have to call them all. I'm not trying to sell viagra here, just offer a mutually beneficially partnership, where no money changes hands.

Well, you could always snail mail them and try as far as possible to personalize each mail to address their needs and how a partnership with your site would benefit them.

I'm just accumulating the data but it should be about 1000 for snail mail and around 400 emails.

Check out the Federal guidelines for bulk email and you should be fine:

    CAN-SPAM Act

Thanks for that. I'm actually in New Zealand so don't think that applies. But I found the New Zealand law which comes into force in September so I guess theoretically I could spam as much as I want...But thats not my intention.

I can't say anything about New Zealand law, but here all bulk emails must comply with parts of the CAN-SPAM act (spam or not).

Sending emails without permission (even they are members of directories) would be considered by a lot of the receivers as spam and can flag you as a spammer at Spamhaus and similar "services." - I rather would go with snail mail.

There should be unwritten spam laws that apply globally. Let's see one of us who enjoys deleting daily spam emails from his / her inbox. If you do care about what the receiver might feel about your email, then you should at least send a message asking for permission to deliver further ads to each subscriber. If you don't, then you might just be one of the spammers.

The recipients will be getting a total of one email from us, plus a follow up snail mail letter a couple of days later. (Costing around $700 on stamps alone)

Both will be addressed to the recipient. There is no advertising we're not trying to get money from this.

I take offense that you imply I am a spammer. If I was why would I be asking this in a public forum.

I believe you are alright so long as you have consent permission.
You aren't emailling harmful messages or spam so it's okay.

You are fine to send them emails. 400 emails is nothing! You will be fine as long as the return address is a valid one, and you have a valid way for them to unsubscribe if they don't want emails anymore.

    Bulk email is legal BTW.....
