The name is registered at Namecheap.com since June 2006 and expires in June 2007. Lately, Webalizer has been down for me. What I can tell you is it usually made 150+ views/month. For some reason, based on adsense, it now makes 50ish views/day! It has never made much income, about 6$ total! Only 2 members as I never went through with finishing it!     You only infringe when you infringe. The name myspace is trademarked by 2 other companies before myspace.com came around. Just dont start a social networking site on it and you will be ok.
