If you have permission from an artist to offer the song for download, then it's legal. If you just gather mp3:s or songs in any other fileformat and put them up for free download it's definately illegal.
It depends on what type of mp3 songs are available. In theory, as long as the author or musicians (copyright owner) explicitly allow you to download and distribute their music, you can do so. Most musicians generally do not allow you to host or download such music, you be infringing on the copyright law and that is illegally. Yes, you can distribute the mp3 as long as you want to get caught and be liable for for massive amount of money for illegal distribution. It does not matter if you do it for free. As long as you do not have the explicit permission from the musicians, you are not doing the right thing.

No because they might not ask you to remove them they might just sue you right away. If your site becomes huge and they do an investigation that you have been providing free mp3 songs of top artists for couple months with thousands or millions of free downloads you will get in legal trouble. The songs are copyrighted. If you live in like a 3rd world country and some how got internet connection then you can do it because no one will probably ever find you...lol but if you're in US i wouldnt do it.
This is a illegal thing to do, no matter if this service is free. BUT EXCEPTION if the artist or record company allows you to distribute the mp3's then it's legal.
If you distribute a song without approval from the artist before you start distributing it you will be held liable for every single copy downloaded from you (or from instance operated/owned by you).
No, you do not host them at all if you do not have the explicit permission to host them in the first place. You know it is illegal, just do not do it. I mean it is like if someone goes into your house and steal from you on a daily basis, does it make it legal for him to do it as long as you do not know about it ? It's the same here. Why do not want to host mp3 illegally ? MP3 files can be huge and take up quite a lot of bandwidth and diskspace. It would mean that you not only have to incur the cost of web hosting which could cost you hundreds to thousands of dollars then every moment you be living in fear for the risk of being caught and facing the hard hand of the law. What would you gain from doing this ?
It's illegal without permission. What you can do (which is pretty sneaky and I've seen other sites do it) is offer free downloads of MP3s but link them to other sites that are offering it (so it's not your responsibility..) same goes with movies.. and such..
Well, it appears that there are people who just like the thrill of living on the edge. I mean why do people murder and do all sort of crimes ? Like they say, the forbidden fruit is always sweeter. Some may just want the challenge or some form of recognition or just to proof to people that they have the ability to do something.

Some websites get away with it because the country they are hosted in/owned in have different laws than the country you are in. Russia, for instance, has a few websites that offer such services.
No,the only thing i can tell you is that here really own such a host.I had talked the stuff from that host.
If you don't have a permission from the artists to distribute their music - it's illegal. Even if you have a permission, don't forget to email Google and explain them the the situation. This way you will avoid problems in the future
Yeah, there are more or less restrictions in different countries but mostly it is not allowed to share/sell copyrighted stuff..
