I am building a website currently. Need Help reg. legal issues

    Dear DP Community,

    I am currently building a technical website. I do copy content from other websites as well...In some websites they have given a copyright link ©xWebsite.com 2005. Do they actually register it somewhere or do they just mention it just like that so that others may not steal thier thier content.....

    also please tell me what action can they take again me if i am copying thier contents and putting it in my website violating their copyrights....

    there are lots of things that can done. you can be sued for copyright violations if the content is not taken down. a DMCA could be filed against you. Your host could shut down your site, if the infringed site contacts them, etc etc etc

    I'm not really very familiar with the law pertaining to web sites. With regards to the content copying issue i get to see web sites with disclaimers just below the contents stating that the information provided is solely for the purpose of providing information and any person who makes use of these information is at his own risk. And the owner of this site is not liable for the inaccuracies in the contents. With this kind of disclaimer, just where copyright law comes in?:confused:

    some ppl just display "Copyright 2001-2005 ABCD.com" without even actually getting the actual copyrights from the authorised people....

    YoByte, what you're doing is called stealing. How would you like it if someone "copied" all your original content and put in on their website?

    100% wrong what you are doing and if you get caught I hope they C&D you and your host and get your site shut down from the host as well as banned on all the search engines. Then I hope they start a lawsuit against you for damages. They can do this and I hope they do. Your best bet would either get original content or ask permission to use content from the sites.

    BTW- There are sites that allow free use of their content such as goarticles.

    by copying i meant not serious copying just basic definitions eg: like VoIP.... those can also be found elsewhere without copyrights....

    if you wanna copy something from someone else site why not use there info as guidelines and write your own unique content based on the facts found in their content.

    this would not be stealing since it is completly different and you would end up with your own unique content

    or is that too much hard work? or maybe your just lazy?

    And I'm not saying stealing is OK - but when the wheel was invented - nobody built a square one, or a triangle one, etc...

    It is OK if you give them acknowledgement - which is the opposite of your idea (abv.). Analogy: You go to a shop; you pick up chocolate; you PAY (the acknowledgement).
    You say: You go to a shop; you read ingredients on chocolate; you produce similar from same ingredients, you eat chocolate for free without paying the original creator!

    that is still stealing and will find yourself in a copyright battle, a lot of sites i have contacted asking to use there content and i even offered to put there copyright link at the bottom and still they said no.

    they wrote it, they are the owners of that certain piece of text, if you think writing a 300 word article takes up too much time i would love to see how your site is developing this time next year

    I am a website designer/developer/manager. It is not my job to write the content, I mearly add little lines of text to templates or copy and paste emailed docs into people's sites for them.

    And the only website I actually run advertises events for environmental organisations, so I am basically allowed to copy things - I don't think I have ever broken a copyright law.

    Also, has anyone ever taken anybody to court over website copyright?

    if you copy someone elses work, without their permission it is breaking a copyright law, whether they press the situation further is down to them.

    whether its a 100 word sentance or an entire website copying is copying, theft is theft and your end up getting stung in the tail.

    A legal / terms and conditions / privacy / etc / page helps and a link to it at the bottom of each page.
    Look at other sites and use parts of theirs and microsoft.com has a good one.

    Oh my gosh, this thread is crawling with lawsuits waiting to happen. Guys, don't put yourselves in such a compromising position. It's not worth it.

    I see discussion about sites needing a copyright symbol. Guess what? 1980 called, and it wants this discussion back. The USA, UK, Canada, and a whole lot of other countries have signed the Berne Convention. Here is what this means in 2005:

    1. Copyright is automatically and immediately granted for every original creation made in a fixed medium (basically, printed out, written down, or painted on).
    2. You don't have to register it.
    3. You don't have to list the copyright symbol or any other notice.

    OK? So basically, everything is copyrighted automatically, and people have to deliberately disclaim copyright if they don't want it to apply.

    There are still certain exemptions. Known facts cannot be copyrighted, such as the population number of a city, or the distance from one landmark to another. But that's primarily a numbers game. Once people start using words to describe facts, that gets into the creative realm. If there are 100 ways to state a fact and you copy how one person stated it, yikes.

    There is also fair use, but that typically involves copying less than 5% of the original work, and properly citing the reference.

    In addition, I know of no law that says environmental organizations are "allowed to copy things."

    And yes, copyright lawsuits happen all the time.

    There are many sites dedicated to finding plariarism.

    I'm not a fan of our overreaching copyright laws, in fact I run a Web site that argues in favor of the public domain. But know the law. Better to change it or challenge it than flaunt it and get hammered.
