    Are they using Xanga or something similar?

    If they agree to the EULA upon downloading the plugin and it states what they're getting then they're pretty much covered.

    Federal Trade Commission should deal with them... or at least know about them. I've heard about a $3M settlement for illegal adware spreading by Zango. They were fined by FTC.

    they are not in the United States. I have deleted thousands of links to such sites from my own forum. Many of them are in germany or russia judging by the IPs I have banned.

    If you tell someone that the software that they are installing will display ads in return for them getting access to the content and they can uninstall the SW easily then it's legal (IMNAL).

    The lawsuits you hear about are related to drive by installs and the such where the user didn't agree to the installation and where it was impossible to remove the software after it had been installed.
