i was searching for my legal rights which i cannot get an answer out of an attorney. locals wont touch internet related manners. i figured i could maybe stir interest and get a clear picture of where i stand from someone who knows. i am on here with a degree of anonimity. yes i posted the link to show the position i was in, although i have found that is not allowed on this board. why are people making t-shirts and calendars....i think they want to rub things in our family's face and/or ruin us. She was the school salutatorian and class president. i am a pastor of a local church and the mayor of my hometown. I am county board president, and i have dealings with the zoning and school board. i dont have many other place to go than to anywhere that will listen.[/B]

this does not make any sense...i have seen one misspelling in what i wrote and it was a typo. call it what you will, this problem is on my hands. It has caused a great deal of heartache in my family and i am at my wits end trying to control the damage caused. The shirts and calendars are crudly made on home computers, so this is not a large operation pumping them out or anything of the sort.
Here's the deal - If what you say is true, i feel for you. I have a daughter and I'd be upset too. But, she IS an adult, and other than meeting with her in person and having words with her, I fear you may be outta luck. There's a lesson to be learned here - Hope she learns it.
After reading this thread, I have questions, and wonder if you overstepping... 1. Is she an adult? 2. Where they voluntary? 3. What is racy? Rhetorical, Dads can be too sensitive. I'm guessing these photos were given voluntarily, so they are the property of the owner(photo taker) and your issue should be with your child. Not being a meanie, just sometimes our kids do dumb things, and we can't protect them from themselves, unless we prepare them as adults. tom
I'm calling shenanigans. If it were real, we've got a simple case here. 1. Your daughter signed a release. If so, tell her to stop taking off her clothes for beer money and move along. 2. Your daughter didn't sign a release. If so, myspace is liable for the use of the pictures and any IP lawyer worth a crap would take care of this matter. Again, move along. So, stop wasting forum space and either come up with a new story or go contact a lawyer and be done with it.
Rather than keeping posting on this forum why not just email myspace at the link I provided and get them to take the pictures down?
Assuming this is real: you can click the link at the bottom of the offending Myspace profile that says "Report Abuse". You'll get a form for a message where you can explain the problem. Honestly, unless the photos are pornographic or otherwise clearly offensive to the general public (not just "racy" or embarrassing to parents), Myspace is unlikely to do anything, since they have no way to determine whether the people in the photos consented to have them up there or not. An attorney versed in IP law will be able to tell you your rights and, if appropriate, craft a legal letter to Myspace to take the photo down. There would have to be additional legal action to block other uses of the photo. Note that the reality is that the more legal action you take, the more attention you are drawing to the situation.
