Is there any problem with reposting matt cutts vids on my site? Other then a bandwidth issue, anything wrong legally?
If they were my vids, I would consider it copyright infringment and take you to court. I would certainly want expressed consent before republishing.
Really? I am talking only about the matt cutt vids he made, I would be hosting them myself though. I guess I could email him and ask, not sure how long it would take for a reply though.
I didn't see a method for contacting him, i guess i could comment in his blog but spamming the anti-spam man can't be a good way to get him to grant consent.
What a silly response. Like the first response from anyone should be some sort of a litigation suit. Or using the legal system is a business in itself or something. Are we all children here? Can we try and avoid settling our differences in a manner other than a "me-me-me" tantrum. Of course we can all just "get mines" now and hope for the best later.
The videos are copyrighted material that belong to Matt. I'm assumming that he made them available on his Blog for people to view, that means that it is unique content for his visitors... he created it to enhance the usefulness and popularity of his blog (at least that's what I think). If you are going to use it without his permission then you will be in copyright violation and basically stealing his content for use on your own site. A judge recently ruled that linking directly to an online video (bypassing the original site) can be viewed as copyright infringement. If he doesn't want you to use the videos, he will at the very least send a cease-and-desist letter, or he could just file a DMCA complaint with your host. Also keep in mind that he works for Google (site removed due to DMCA request anyone - ok, that part is a joke, but still it's possible that he will file one). So, my advice would be to obtain permission from him first. In most cases people are happy to share their work, but once you have used it without permission they are likely to "unleash the dogs of war". Just put yourself in his shoes... if you create some unique videos for your site, would you want anyone else to host it on theirs without getting permission first?
I don't think it's a good idea to use them. If he wanted everybody posting them on different sites he would have put them up on YouTube. At the very least, you should write and ask permission. Or download them, upload them to YouTube and embed them. That might be interesting.
It's not reallly a silly response. There are a concerning number of webmasters (especially people new to the game) that seem not to give a damn about copyright and feel that they can copy anything and everything on other sites for use on their own sites. It's to be expected that the copyright holder who put in a lot of time, effort, and in quite a few cases a lot of money, to create that content would take legal action against the infringer. I can tell you that trying to play the nice guy in a copyright theft situation doesn't help much.
Really? So your first response is always filing court papers and suing for infringement rights in a court of law? This is the advice you would give people? These types of court cases (we are talking US, or at least both parties in the same country) are a very long drawn out and an expensive endeavor. Even if you are to win, chances are you will not see a dime or a dime over the litigation costs. So keep pushing silly advice like this because there are always lawyers that need the work.
I never said that sueing someone was the first option. A cease-and-desist letter and then a DMCA complaint to the host and SE would be the best action. If the content is valuable enough you can then sue as last resort.
I'm very sure that he wouldn't mind me reposting them, my purpose would be to allow people in countries which aren't allowed by you tube to view them.. I haven't seen them myself. My website has a services section but most of the sections are purely information and non commercial in nature. Anyhow anybody know how to contact him?
I don't see how it is a problem, considering he posted it for public viewing on google video, and that allows you to repost those on blogs using googles embeded player. He would know that...
If you are talking about Matt Cutt's videos on Google videos, I believe you are allowed to put them on your site. Out of respect for Matt, I would put a link to his site. That way you are not stealing his information making it seem like that it's you supplying it. Possibly put "Information by Matt Cutts" with a link to his blog. If he does sue you or take actions against you, I feel Google responsible because they ENCOURAGE you to embed his videos on your site. They give you the option AND the code. But I'm not a lawyer or know much about legal issues. This information is just coming from your everyday human.
Well i've asked a guy I know who works at google to either provide contact details or contact him within the plex so hopefully that works. Otherwise I'll just post them on my site in a couple weeks along with a linkback. I doubt it will become a problem since the postings won't be making me money (the opposite in fact) and will help more webmasters out.
True but I'm not going to user their player at all since it doesn't allow people in countries such as china to download their videos.
Lets wait for feedback after you contact him, I want to know this also since I use a video of him on my site, although I give credit.
If he didn't want people to repost the videos, he wouldn't have put them on Google Video where you are actually encouraged to use the videos on your own site, like with YouTube. He won't have any problems with you unless you say on your site "this is me and I created this".
I think my site's rep might take a hit from that since the majority of the traffic are webmasters and SEOs..
