What are you confused about? Spam = unsolicited bulk mail. If your email marketing is unsolicited then yes, it's spam. Simple as that.
Any unsolicited mail would be considered as spam. Sending emails to an opt-in list shouldn't be a problem though as the users have themselves subscribed to recieve email by providing their email address.
There are e-mail newsletter services that would help you circumvent whatever trouble you are having with your server + give you metrics on the newsletters themselves.
Hi Tata. Many companies use email as a communication channel. Tesco, a leading supermarket chain in the UK sent over 40 million messages to customers in one month. Sounds like spam, right? Not at all. They have a large customer opt-in list and email special offers to that list. Permission marketing requires that the sender have the 'permission' of the recipient to contact them via email (or any other channel). Spam isn't only about the volume of messages though. If your subject line is deceptive, if your message doesn't have a reply-to address or if your email fails to include an opt-out link, it would be spam (even if only sent to a list of 10).
There are many rules for sending mail.. Personally, if I was sending email to a mailing list, I would probably use a little service once it gets over say 100 people or so. You have to make sure your email doesn't violate CAN-SPAM laws and what not. Places like Blue Hornet does emailing, but I don't know the price. My company uses them to send out mail.
