Chargeback Fraud: dimmak herbs (website review : dimmakherbs.com )

    A member with the username dimmakherbs contacted me regarding a CD cover or Album Design. His real name is Sean Russell. He is the owner of the company DimmakHerbs.com.

    Then he contacted via email and ordered the Ablum cover/ CD cover design. On Oct 15 2014 he made the payment. I sent him a screenshot of the payment and he confirmed it saying " Yes that is my payment" Then he ordered another CD cover design on oct 28th. The job was closed on Nov 7th 2014

    Today, I got an email from Paypal regarding chargeback. Where he says, he didn't authorize the payment. This is completely untrue. I have the details with me where he confirms the payment. He made payment using his company email and contacted me via gmail id. His who is details: https://who.is/whois/https://www.dimmakherbs.com

    I checked his profile and found he is cheating others as well.

    What should I do?

    I know he is clearly scamming you, but I have to ask, did, at any stage he email you FROM the email address that payment came from? -> this is very important in order to have any sort of protection from paypal. If at any stage you contact via one method, but payment is from another email account, you must ask for them to send a message FROM the paypal email address to state that they authorize the trasaction for $xx

    I know this is very bad advice, but if you DO lose money on this, be sure to post your proofs on his facebook, etc as this is daylight robbery.

    He only contacted via his gmail id but I had sent a screenshot of the payment and he confirm it. Luckily his website details (who is details) matches his paypal account address and phone number. His website is registered under his name. I have sent all the details to paypal including Google cached links incase he changes the information.

    I don't know what else I can do. This is sad :(

    Update:
    Paypal is disputing with the credit card company but I have no hopes :(

    I request everyone not to deal with @dimmakherbs . He will rip you off. :(

    The fees to file a legal case would likely be close to what you lost. You likely, would also have to come to the US to file the case. I don't know what other steps you could take, besides posting about this experience like how you are already doing and prevent others from succumbing to it. Sorry I could not help further picxy.

    This seems to be happening a lot lately. I am out 200 bucks from the last 10 days alone.

    Is your work live? The stuff I have been dealing with has fake icann info, does nothing but scrape peoples content and so on. I am going to spend the day punting asshats from google and having hosting accounts shutdown.

    I have officially had it with this place. People getting fleeced is simply too entirely common here. This place used to rule the day. Now its an exercise in futility.

    Yes my graphic designing business is still going on and I make a living out of designing and blogging.

    I couldn't agree more, Digital point is now filled with scammers, irrespective of what country they are from.

    He probably ask you whether your stuffs is used in an online site or not.

    It is easier to bring down the whole sites which have your hard works rather than file a legal case. Most 'fraud sites' have fake icann info (which I prefer to call it WhoIs) - (as what Nigel have stated above in his comment) but it would not completely hide their identity. It would be much easier to do complex trace-route and data comparison to hunt any sites owned by the person whom using your hard works. Some peoples prefer to have direct communication with registrar which hold the domain and notify ICANN if the registrar didn't respond to the request. Another peoples maybe would file complain to hosting company which serve the domain and sent take down request to several sites including most search engines.
    I didn't recommend to do this as doing it maybe would give more trouble (there is a chance that we may target wrong sites/peoples). It is an activity which require much passion and lots of accurate data to identify the site).

    I always believe filing legal case is the most appropriate solution to solve the problem related to fraud activities.

    Yes client is using my work on his facebook pages and also on amazon, cd baby etc to sell music

    In this case, I have found the owner and I even spoke to his friend or partner via facebook and she assured me that I will get my money if sean doesn't pay. She said, she likes the ablum cover that I designed. But later, she asked me to settle issues directly with him.

    too bad you got cheated. The credit card company will be in favor of their client.
    and paypal will not care because it is digital goods, and they dont get involved, and
    will not matter how much proof you send to them, they wont care; my guess is that
    these people have a history of doing this, buy something, get it, then dispute the
    the charges, and do it again when they find something else that appeals to them, then
    you end up spending time like this chasing them, losing even more time and money....

    I am sure fraud happens in the real world too...
    Business, Retail, etc...You just may not hear about
    it because they do not whine about it on forums....

    When I had a business years ago, I got a chargeback...
    and I had a signed receipt. She forget that she made
    a purchase (like most people do) and the first thing
    she did was file a dispute. It cost more time and money
    just trying to convince the cc company that this was
    a legit charge; in the end, either lost money or broke even.

    In the end, he spends time, which is money chasing this guy down
    by spending an hour+ by posting all this stuff online. paypal
    doesnt care, credit card doesnt care, no one can help him, period.

    I would like to think you can only cry wolf so many times.
    Sooner or later, paypal or your credit card may think you are
    crying foul and you are doing to many disputes, but this
    absolutely does nothing for the other guy...

    I wouldn't really say it's "whining" to post this, especially when it's involving 2 members on the same forum. I'd rather know about it, then have dealings w/ that member. I would have likely done the same thing.

    If I didn't report this here, other members would get cheated as well. I won't mind spending time to write something if it helps others. If you check "Dimmak herbs review" you will see what comes up in google So even his customers will understand the type of person they are dealing with.
