Hire a Lawyer? Dotster Stole my Domain!

Discussion in 'Legal Issues' started by sem-profiteer, Jul 25, 2014.

I bought a domain name from Dotster in June and now they want more money for the domain. They are saying it's now a premium name and they want to charge $3500 for the domain that I purchased 5 weeks ago. They charged my credit card, so I feel I own it. Right? Domain is : vitamin.reviews and since I have a confirmation of purchase, what can I do?

I just see this outright theft!

Where would I get a lawyer to resolve this? ICANN can't help. I don't know where else to get this resolved. Any suggestions on getting Dotster to honor their sale? Or the best way to get a lawyer that that knows internet law?

I'm not sure exactly what you're saying. Could you clarify? YOu bought the domain and then they claim that you did not or they just took it over, or your domain payment method did not go through correctly and they want to keep it? I"ve not worked with Dotster but this sounds quite odd.

What he said. If that's what happened then something is just too odd about that. I'd get an attorney and send them at least aletter asking them to clarify their request.

To clarify, I bought a domain that was listed available on Dotster.com. They charged my credit card and sent an email confirmation. When I went to change the DNS to point to my server, they had removed the domain from my account. When I asked what happened to the purchased domain, they stated :

"Your domain 'vitamin.reviews' is premium domain name available for $3,125.00. In order to get this premium domain, you will need to pay for an amount of $3,125.00.

Meanwhile, I've refunded the domain registration charge of $25.99 to your credit card. While we process your refund immediately, it generally takes seven to ten business days for your bank to post the amount to your bank account."

Please note that they acknowleged it was my domain with the opening of "Your domain 'vitamin.reviews'"

Since I already bought it for $26 and it was later deemed a premium domain doesn't mean they could charge me again for something I already own, right?

and the final answer from Dotster is :

"We understand that you're disappointed. Unfortunately we cannot fulfill your request and honor the registration because we were never able to secure the domain registration. We apologize if this answer doesn't satisfy you, but it is the answer."

Where would you find a lawyer to stop this injustice?

I guess I can understand where you are coming from...

What if I had a prem domain, and one day my register decided that it was
prem, so they take it back, give me a refund on a domain that I just
bought or even had for years, then jack the price up on the domain....

It clearly seems like they made a mistake...and I bet if you read
the tos of service, then I am sure mistakes like this will be covered
    to some degree...

It is unlikely that an atty would help you out, you have nothing
invested in the domain, and they gave you a refund, but I
do clearly understand where you are coming from...

It seems that a register has ultimate control of your domain
as long as it is in their hands, and who is to police the domain registers?

If you believe that much in the domain then pay the $3k; This
way they can send you another email and say, since you paid
$3k for the domain, we now think you will pay $5k....

Yea, I thought someone should be policing them too. I did contact http://get.reviews/ that might be the sole place that is controlling the domains, but haven't heard anything back. Whelp, if this is common, maybe others will find out who has or doesn't have integrity selling domain names.

If anyone knows of "police" for domain scams, please do reply. Thanks all for your tips.

for what little it may accomplish...

you can also submit to scam sites such as RipOffReport.com

Be sure you list everyting about them, including their name, phone
numbers, url, etc and when people go to look for reviews on
abc register then they will see the review you posted...

I posted a bad review for brandondale chaska mn back in
2010, and if you do a search; sure enough, it shows up on search results.
