freelancer wants to book FIR against me

Hi,

I run a chat script project and i have been came across internet fraud 1 times and this is the second time with fraud freelancers.

I and the freelancer both are from india but from different states.

I posted project on elance with 18 task and the freelancer bid on my project of $220 and i clearly mentioned in the project that i cannot pay more then $220 and he said yes he will complete all 18 task in $220. He even fixed one issue for which i paid him $25 as advance on getacoder.

The deadline for freelancer which he set on elance was over and he didn't even uploaded source code on elance.com.

He fixed 2 to 3 issues and just showed me how it will work and told me he will complete remaining task only if i pay him $800 to $1000 i rejected him offering $800 to $1000 when i posted a project with 18 task on elance he agreed to complete the task now he tells me to pay him for the 2 to 3 issues which he fixed i said i don't want incomplete work. I have $220 for complete project and his work was not quality work which he showed me so i said i don't want your work and i will not pay you because on elance i clearly mentioned i will pay only $220 for completing 18 task.

Now he says you are muslim and in india i will book FIR against you and book case against you as you are muslim under jihad act.

Yes that's right, the person is hindu i never had bad experiences from hindu people, i have many hindu friends but this guy looks anti hindu.

He is threatening me since 5 to 6 days and telling me that he is rich and he has professional lawyers who will book FIR case against me.

This guy is from Indore, India and i am from Hyderabad, India.

Can you tell me what i must do now ? I have already contacted cyber crime.

On his getacoder profile he has worked for adult pornography website who provides child pornographic content.

I have his picture and his mobile number, can someone suggest me what i must do ? i have already emailed cyber crime against him since he threats to book FIR case against me.

I also want to know can we book FIR against anyone from different states without having address details ?

 

I think this case should have been disputed on elance itself. In fact they are the first party to be contacted since they are like the middlemen in your case.

I can only laugh upon hearing this. So for about $1k, he will hire his professional lawyers, pay upto $2-3k at least just to sue you.

Most likely he is just trying to force you into paying him his desired fees. Clearly, by bidding on your project he has agreed to do those 18 tasks for $220. So now he cannot sue you since he agreed to the terms already.

I do think inter-state FIR can be booked. But there's nothing substantial in this case if you ask me.

This jihad act is the stupidest thing I have heard in a while.

Anyways, make sure you have sufficient proof to make your case stronger if you have to tell your side of the story to elance or anyone else. Keep a copy of all your conversations, transactions and the work he has done so far. Make screenshots preferably instead of just text logs.

is there anyway that you can get your $25 back, seeing as how he hasnt delivered the final product?

all this sounds familiar to me. It has happened before where people bid on projects at freelancer, and simply plan to outsource all of the work, thinking they can hire someone at fiver to do it for $5, and things never seem to work out the way they think.

Between you and me, I think we should be able to sue freelancers that are late. He will be causing you damages everyday that he is late on delivering the project.

 

some kind of same thing happen with me long time ago. Some one from Pakistan charge me hrly charge. Well, I never send him any upfornt first, then Freelancer force me to pay him, then I mentioned fixed amount for the job but the guy asked me for hr-ly when he fished the job. I contacted freelance support and asked for money back - they didn't give me money back and even asked me to pay him. But I did't pay him any money - after like 8 months later I got mail from the guy with every thing and a complete project. And he just asked me to deposit the rest of the money to his Paypal account. I told him I leave the project long time ago so i have not that much left - I already invested on another project. He asked me to pay the half of it. He also said he working for a Pakistani company who took jobs from freelancer kind of websites, but he contacted me through my AD. And the other guy from his company try to earn more from me which he never, ever supported. Anyway, I paid him and I stay with a project which I lost interested from - totally useless.
So you see the guy emailed me was a Muslim and they guy try to rob me on Freelancer both are MUSLIM from same county. But the complete diff sole - so don't worry if someone hurt you or tell you going to sue you.. If he did then you stood of for it, otherwise ignore it. Try to fix everything with you hart.
In my opinion there is no MUSLIM or HINDU or CHRISTIAN. Or NOT some one from India or Pakistan or Bangladesh - Only 2 kind of people existed GOOD or BAD. Now this is your time to choose which one you going to be. Your actions make you the person you will be - think wisely.

@OP - You don't have to worry about this issue in all cost. Just dispute the payment. You don't have to bother by him anymore.
As you mention you already contacted cyber crime department, that's unnecessary!
If you have, your personal cyber lawyer, that will help you in future and make sure, if you can to find any smart person from Legal Department as well - they highly help you in any cost. But in your case, probably you don't need any of those.
As with his behavior, may be he is teenager or not a financial stable person or could be both. Just try to relax and enjoy the show. I'm so sure that, he can not do anything.

No, you are wrong. You can file report any state as long as if under the one country.
Yes as jainy mention, I also believe, their is no so called JIHAD law in India ( not sure about Pakistan, Bangladesh and other related Asian countries ).

You seems to be afraid by his threatening, make sure you try at least a bit to relax.

There is nothing like Jihad Act. The guy is a clueless idiot and has no idea about law. You have nothing to fear.

An FIR can be registered in India against any person residing anywhere in the world provided the police is convinced that the matter falls in its jurisdiction. Sometimes police registers FIRs even against "unknown persons".

As the project was not completed, there is no question of you making any payment to him.

As you have already told him that you won't pay for incomplete work, there is nothing more you need to do. Just ignore him and do not reply to his stupid mails.

 

That. I try to refrain from judging people based on their beliefs, but the person the OP is referencing seems to be a royal dirtbag.
