Can I use images from another site, they are uploaded by their users

    I am building a web site with cooking recipes, health advice and news. but I want to get the images from another site but it is for the Croatian visitors and my web site is for the visitors that speak German language. Their articles are written by their users, so the images are uploaded by them. Is it illegal to use those images in my site? and maybe translate their recipes ?

    Using their images is illegal under US copyright law, I do not know about the law in whatever country you are in.

    It's also illegal in Germany, so no dice.


    Regarding translating the recipes - I think that's a grey area, but you are still basically stealing their content. I wouldn't do it and also not recommending to do it.

    Yeah but the recipes are more like international, its not their work, they didn't invent it! its just that they got it from somewhere and wrote it on the internet, which means I am not stealing their work right? and I think I am going to add pictures from flicker but with some rights allowed and add the source of the image (the author original image page) under the images, is this a problem?

    I'm trying to cut some corners here. This might sound very silly, so please beware. I wonder if I can take a picture with my own camera of a digital photo from Google Image and stamp my company name on it. Technically it is my own photo. Will this prevent from being sued?

    You still take something that you don't own. Stealing from a thief is still stealing. :eek:

    But translations are pretty tricky. I would contact a lawyer in this matter

    Nope, because you just made a copy, you didn't create the original. The person that made this image (the copyright holder) can still sue you for that.

    Don't expect to get a factual, correct response here. This is a specialised subject that few people know the facts about. All you are going to get is a load of opinions, not facts.

    Why don't you contact the site's owner, explain that you want to use his stuff and see if they will agree to this in return for (say) some backlinks to their site or some other form of acknowledgement. Then all you have to worry about is being penalised for duplicate content, and there are plenty of ways around this problem.

    Taking pictures without asking the owner IS illegal. That is a fact.

    You can translate and use your own words. Compose it your own way. It also depends on the owner and copyright of the recipes. But you were asking about pictures... If the pictures are yours and you saw it somewhere else without proper attribution, how would you feel? There's no harm in giving proper attribution.

    Truth be told, I'm developing an app that requires a lot of images, and I must rely on Google Image to get all these pictures. I've already sent out more than 10 emails to different agencies/photographers/blogger seeking permission to use their photos. It's been a week and I'm getting no replies. I would think they don't really care about my request and may have just ignored my emails. I looked at flickr, wiki commons but these sites don't have the quality pictures I can find on Google Image...I wonder if there's a way to simply buy these permissions so I can use them..
    Anyone can give me a hand here?

    Well, there are some stock image platforms that sell picture licenses. I don't know a reliable website, though, so you either have to wait for someone that knows a good one, or search Google yourself.

    Allowing picture uploads or using pics from other sites (whether embedding or uploading to your own server) without at least citing the source right underneath is a sure way to get a cease and desist notice (and possibly a costly one) by some smart*ss law firm employed by the copyright vampires.

    There are exceptions, though, like some images under the creative commons license.

    the images are under the creative commons license. I choose the images by their license. so is it too a problem?
