I have a new offer/website coming out that will use these so called "self shot babes" circling the internet! Am i legally allowed to use these images? or how can i cover myself?
As a starting point I'd require whoever uploads a photo to confirm: (1) their details (and I'd verify email address); (2) that the photo is of them and they're the copyright holder; and (3) that they're over the legal age of responsibility. This will vary from country to country, but the last thing you want is for some ex to post a picture of a girl, particularly one who is under age. I'd also run a pretty aggressive take-down policy - if you get a complaint don't argue with it, take it down. Not sure that get's you over the line - the usual consult a lawyer etc - but it's a start
The problem is these will be mainly images i have gathered online and yes they can also submit some! Yes i will run take down policy also!
I'm afraid I can only refer you to my fave saying when it comes to legal questions.. If you need to ask the question you already know the answer!!!
Ive heard that aslong as you got the images from a public domain and cover yourself in the disclaimer your good?
I'm afraid that's completely wrong. Most images online are the copyright of someone else. And, depending on jurisdiction, it is not necessary to put (c) next to an image in order for it to apply. The only exception are some images that are "public domain" and available for anyone to use (though often subject to certain conditions and types of use), but certainly the manner in which you're talking of getting images, and the types of images you're going after, will not be "public domain". Not trying to discourage you, or tell you no (everything must be considered on a risk vs reward basis), but this is a pretty competitive marketplace, and driving traffic to the site will be tough. There's a danger you're opening yourself up to some headaches with the potential of not much reward.
I can't say - some of the photos may be legitimately uploaded others not. My view is don't worry about what others are doing, focus on what's the right thing for you
If some chick uploads her photo to site A, that does not mean site B can come along and just use it. So the fact that you are taking photos found on the internet gives you no rights to use them. Basically your model is based on the fact that you are stealing tons of images and hoping not to get caught. If you are asking for legal advice it is something you should not do.
You're stealing images. They are not public domain. It is not worth the trouble. There are plenty of fake "amateur" porn sites and fake "ex-girlfriend" sites that will provide you with free and legal content to use as long as you promote their site.
