    YouTube hides behind the safe harbor provision in the DMCA.

    Basically they can't be held responsible if one of their users uploads copyrighted material without their knowledge, or so their lawyers claim anyway. If they get contacted they take the video down.

    Hmm, it's going downhill that site I think most people knew copyrighted material would be cracked down on. I heard the English Football league have taken down all the goal videos on youtube now.

    Surely they won't be the last either.

    yeah, tke has it dead on. It's not really hiding though, it's just limiting your liability. If you actively filter out certain material, you could be held liable later on for not filtering out something similiar, or missing something, etc... Plus it'd cost a lot of money to have people whose job it is to do that. Basically, it's a lot easier to assume no liability at all than to be held accountable for something that was merely and oversight or accident.

    It's the same reason Google doesn't filter their search engine results.

    Well it was originally meant to be a place where users could upload videos that they have created, so I'm assuming much like that... I really don't go on their looking for copyrighted material, so it wouldn't effect me at all. There are enough people creating great video just for the sake of putting it out there for others, so I don't think it would hurt the site all that much.

    90% of the videos are copyrighted or have parts of it copyrighted (e.g. soundtracks).

    YouTube couldn't win much with the soundtrack, users are allowed to implement copyrighted soundtracks in their created videos and YouTube pays for each view, only artists members of the mpa I think.

    You will find that alot of sites online are breaking copyright laws. There is copyright infringement going on everywhere, just that there is much more on some sites than others.
