I have a question regarding ringtones.. is it against Google TOS to have a website that offers free ringtones.... are they copyrighted anyways?

and if they are copyrighted.. how do people make money off ringtones? i know it's through CPA networks like Azoogle.. but i mean what content do they offer on their website..

Now I may be wrong, as I'm no ringtone expert, but from my layman's perspective ringtones are just modified versions of songs, which are copyrighted. Most sites that "gives away free" ringtones are just affiliates to bigger networks, which it is assumed have licensed the songs/ringtones they are selling. Since you are just sending traffic over, you aren't in violation of the TOS. But if you set up a site and give away ringtones on your site, then yeah, I think you could be sued for copyright infringement, which would mean you would be violating copyright, which would be against Google TOS.

But again, I'm no expert in this field are a copyright lawyer. Maybe someone who treads in this niche can fill you in with stronger facts.
