I'm no legal eagle, but I believe that providing it's a fansite or something with no commercial purpose (no ads at all) it can be allowed. I remember reading some news about Gaga trying, and failing to take a domain off a fansite. http://oberipwatch.com/2011/11/28/lady-gaga-left-“speechless”-after-domain-name-dispute-ruling/ That said, you'd be better off asking in the legal section here I think. There's a few people there who are pretty savvy when it comes to TM law.

Yeap, if they do have the right with the name been register in copyright , patent and so on . They can sue you by paying them for the lost and they can get your domain away for free. Do check the legal issues before taking domain name especially brand name keyword.
I'd be wary about selling it also. It'd honestly be better posting in the legal section about this. Making any financial gain from a domain that is covered by a patent probably ain't a smart move.
From my understanding, you can only use the domain for a non-for profit or fan website. You can't actually make money from it.
Why would you want to do that? Are you planning on running Adsense or other ads? If so, that's also "bad faith" & another reason for them to be able to take it off you.
I read about an article on this and from what I know they can't touch you, if you do not do anything with the domain......I mean if you do not open it. If you just keep it bought but inactive they can't touch you, because the fault is not yours, is the one that actually sell it to you. And why are you all saying they can take there domain away from him? it was something for sale over the internet.....if I buy a T-shirt with the name Max Payne on it, they can come and take it away because they have the rights over the name? NO they will check the seller if he is allowed to sell them....not the buyer.
While what the majority of people are saying in this thread is correct, the overwhelming majority of gaming companies will have no issue in you creating a website AND generating revenue from it. I know this because I have used many supposed "trademark infringing" domains in the past 4-5 years, and I've ran into no issues. If I ever feel as though I should be particularly concerned, a quick email to the company to enquire whether they would have any issues with you developing a site will provide you with a quick answer. Whenever I have done this, apart from in one case, the overwhelming reply has been along the lines of "We have no issues providing you are not reflecting the game/product in a negative way". When in doubt, just email the company that owns the trademark, 99% won't have any issues providing you aren't intending to start a smear campaign regarding the game/product/etc. WebDev
