Hypothetically what if someone wanted their employer to list their spouse as the employee on record for their work, with pay checks and all paperwork under the spouses name. Are there any legal problems that the employer may run into with that, and if so what?
In the United States it would be fraud, on behalf of both the employee and employer to engage in such a scheme. Not knowing where you live, it would be impossible to say what laws would apply and what problems you might incur. I would imagine someone who is collecting unemployment, but whose spouse wasn't, would consider doing something like this to keep getting their payments while actually working. That would of course involve another fraud on the State or Federal Government. There are also social security and other implications. It depends on the job, the employer, the legal status of all the parties. Pretty much, it is a bad idea all around - from a legal perspective.
In the US that would be fraud. No respectable or legal company would ever even consider this. If they were to be audited, could be jail time, big penalties or both if the employer has knowingly did this, and this includes all parties, the employer, employee, and anyone involved in this scheme....
