Looks more like a publicity gimmic to me. UTube can not be that stupid as well as there lawyers who must be knowing the reality and the most likely outcome of the case.Oh by the way talking about the traffic, I don't know much about UTube but I guess the traffi is pretty much useless for them(they claim - The Largest Stocking Dealer of Used Tube Mills & Used Rollformers in the World 125,000+ Square Feet of Used Tube Mills and Used Rollformers).
Silly people. The don't need to monetize their site's traffic , it's not their business . "Cashing in on traffic" ? What cash ? At best , that site would make no more than 1800$ a day, and that is if they actually put some thought into it. That is less than your local coffee shop, and if you woull look at their website ... " You would understand that the company probably makes no less than half a million in sales per day, and doesn't need to enter into the micro-money niche of online advertising. A single person that contacts them through the website is x10,000 more valueable than any visitor, and screening "I want videos !" idiots could make them miss real business opportunities.
I agree with you hear. If you have been running a successful business and then something like this happens and you get alot of useless traffic, you don't just start changing what you have done for your business in the last few years and just put adsense or other ads up. But then again, I don't think it is Youtubes fault either. How do you know that when you buy a domain, that it is similar to another persons. I have never heard of utube and most probably youtube hadn't either.
Ummm the trademarks are not similar in any way shape or form. Date of Corporate inception would likely show utube to have existed longer and by continually promoting their trademark could not be sued by youtube. Good research ComputerJew however US Law does not require a Trademark claim be filed in order to make the trademark yours. Prior US Legal findings have stated that in order to claim trademark rights the company must actively use the trademark. If the trademark is not used... then it can be taken by another company. Also you might want to see if Utube had registered this as a ServiceMark...
