May have duplicate content. 05. Link structure of the site is very poor. 06. Blocked by 'robots.txt'. 07. Excessive use of flash. Reasons for get penalized: 01. May have duplicate content. 02. Contain so many frames (iframes). 03. Very slow page load speed. 04. Spamming. I have created a blog post about this. And there can be more. So share your ideas. Ya, definitely you should be indexed before you get penalized. I just wanted to mention reasons for both. Really sorry if the title confused the contents. My bad. Thanks for pointing it. I edited the thread and add more details.

@wiwefak - lots of people have great on-page SEO but then they go out and buy thousands of backlinks only to get penalized. I hear that Google is sending messages to site owners though Google Web Master Tools if they suspect suspicious backlinking. Setup your site in Google Web Master Tools and check it weekly to ensure that you're in good shape.

Search engines hates copy content and may drop the page from their index if found another instance of same page over internet. The other factors you included are absolutely true. A loading time and spamming can lead to such action as well. I would like to add one thing to the list: WEBSTIE DOWN TIME.

So do not waste your time to link to so many site. When you submit a link to another site check the PR of that site. Try to have backlinks from sites which have PR 5 or higher. "Post same link to so many sites on the web will consider as spamming. Specially if you do not have rich contents. Search engines do not like to force them to index you using unpleasant ways."
