Yip, looks like DMCA staff is back from summer vacation.
You cant blame DMCA, neither can you blame Filesonic - both do their buziness.

Curious - I've found WU to be just as keen to delete files as FSN - can't comment too much on oron as I don't use it to upload, however I must admit that when people post multi's it tends to be the oron mirror that's still working after the others have deleted the file/s, and the FSN miror is often the first to go.

So what does this mean ? Well one way to look at it would be to say that FSN just delete files too easily - another way to look at it would be to say that oron ignore dmca notices and don't seem to care much, where as FSN comply with them in order to stay in business and keep us all 'employed'.
Despite denying it I strongly suspect that FSN does not do any checks at all on dmca notices, and just delete files, but that's true of just about all file hosts - think about it ... they must get hundreds of the damn things every day, so if they where to check them all properly they wouldn't have time to do anything else ! - it's just not practical.
I honestly believe that the file hosts are backed into a corner here - they're damned if they do and damned if they don't.

I too have suffered at the hands of obviously fake dmca notices - I've had public domain files deleted. It's a pain in the arse for sure, but honestly the only thing to do is just get on with the job and accept it as it 'goes with the territory' (there's some shady characters out there lol !)

In this matters, FSN is the worst of all out there. They just delete files without caring if the DMCA report is fake or not. And the worst thing in top of that, they delete all files from all the subfolders located in the same area of the reported subfolder. If you have a folder with 50 subfolders inside, they all go to trash. 50GB of my stuff went to trash because someone just complained about one single title. Oron or Filesmonster care to check if the report is fake or not.
Indeed... There's some shady characters out there.

I have to state a point here..
When a Premium user downloads 5 of your uploads
only the file with lowest filesize s accounted?
    Why is tht ?

i had 4 -500 Mb links and one 50Mb link
The download is counted for 50mb link :(

    Any clarifications ?

I too face such problem, best solution is to mirror those files with another host like wupload, uploadstation etc thus downloaders will not get disappointed seeing dead links of filesonic also dmca fake reporters can no longer stop you with fraud tricks.

I enjoyed reading this! Not that all what you say is well-reasoned and the only and correct explanation of what is happening, but because it all comes from your heart and you still manage not to give way to emotions. I like it when you actually oppose a file host, and put yourself in its place all at the same time.

Same as you we all want to find out the real truth abt why our files are being deleted when there is no direct and clear evidence (or even no reason) of a verified DMCA notice. In my case... I actually gave up with filesonic when one morning I found 10 DMCA marked files out of total 30 files. (I hate RUing/leeching, and losing those files was not the most pleasant thing as my local upload speed is only 25kbps). Some of those files had absolutely no problem for 4 ears (ever since I started with Hotfile), none of them belonged to same production company, and all of them were most popular. How come all these files deleted on same date/moment? I have no clear explanation...but the fact is they were marked DMCA.

My first thought was that some rival from some popular forum has created a fake DMCA notice. Low traffic forums are not interested in "killing" new members. But It is quite possible that high trafic forums have an inside mafia - they might let a newcomer bring new unique content, then "DMCA him" and let own elite posters to repost it. Also it is possible that you could post material that is posted earlier by an elite member...you are either banned or DMCA-ed again (the smartest way). Some high traffic forums even have a list of absolutely legal (adult) sites the content of which you are not allowed to post. If you post it - your files are reported immediately. So...powerfull forums do have a deal with orginal content owners. ...Whatever... I cant prove it...but the fact is that my filehost decided it has grounds sufficient enough to DMCA my files.

The second thought also has strong grounds to be true. DMCA is picking up in pace and works out more and more sophisticated anti-pirating schemes. Who do you think is the main target? Large and popular file hosts indeed. Hotfile is dead, did they want it? No. But they were backed into a corner. Megaupload had great problems with the law, they didnt count reward points for months. Duckload (and some torrent site) owner arrested. There was an attempt to ban FSN, MU, and a few other popular hosts in UK (remember the latest BT scandal?)... Well...this might expain many cases of massive file deletion (dont you thinks so?). The more popular you are - the more powerfull enemies you have. As regards Oron...well well...arn't those guys from Russia... one of the most corrupted countries? What's US DMCA for them?

    You know..many other thoughts...
But recently I found a guy who created his thread here at DP. here is the link Fully managed DMCA take-down service!. Actually he is some sort of e-cop who does not even need a licence to carry out anti-piracy activity. Most probably he has been pirating himself but now he decided that being on the DMCA side is more profitable. He actually wants to be paid to act on behalf of copyright holders. I suspect he is not the only one out there:) Now...guys like him could create "a package of copyright owners" (the more popular the better) and target some great poster to "work" on his files...

And here is a web page where you can generate a DMCA report on your very own lol: Free DMCA Copyright Notice Formatter.

I mean... you know..... shit, damnit!
But a file host really has to do checks on ALL dmca notices.

    Sory for my English
