News Portal Photo Issues!

Discussion in 'Legal Issues' started by Fem, Mar 13, 2011.

Is there anybody knowing the legal side of using photographs in news portals?

=> Can we use the company logos on a news regarding that specific company?

=> Can we use photos of products [Eg. iPad] while posting news related to it?

=> Any websites to find free photos for websites & news portals?

    Thanks in Advance.

It depends what countries are involved, some countries have a "fair use" clause in their IPR law thus allowing this sort of thing. Others don't (and of cause some countries basically dont have IPR)

As above, with the added element that for photos you would also need the permission of the photographer or whoever owns the rights to the images

Only a few and most of them offer no indemnity against copyright infringement so if it turns out an image was posted without the authorisation of the copyright owner you can still be sued. Your more likely to be better off buying the images, depending on the sort of "news" your reporting then the low budget stock photo sites like istockphoto may be suitable.

I dont think so, newsworthy photos are usually done by big outlet such as AP or Getty. They will hunt you down if you use their material for free while other news outlets are paying for it. Provided that your site is somewhat famous

You can try submit your site to be included in Google news, you need to have clear physical address, constibutors etc on the site. But no, you cannot "register" to be an authority site

Thanks for the reply. Actually, I have planned to submit the site, but I was told by some guys that Google won't accept the site until it has good traffic and huge content base that has been being updated daily. I add only 5-10 news per day, and is having only 100-200 UV per day. Will it work and will Google accept it?

Yeah it's not a great idea to help yourself to content that you didn't license or create or have spent a ton of money vetting any legal issues.

If you are not sure don't count on the advice you are likely to get from here. Spend the money on a book called "Publishers Guide to the Web" by Jon Hart. or get an attorney's advice.

AP, Reuters, AHN, Getty and others religiously police their copyrights.

You should do it right now, dont wait. Like I said you need to make sure that your site has an offline address written clearly, have maybe 3 or 4 editors or jurnalists with their info stated clearly maybe on the about us page and an easy way for visitors to cantact you should they need to. For technical requirement, your url for each news must be unique and contain three digits idetifier that dont resemble date, you can change your permalink to include post ID if your post ID is at least three digits already. It is also recommended to have normal categories such as business, headlines, environment etc, they'll ask for it

Just give it a shot, if they reject it keep communicating with them as to why it is rejected, some people tried many times before it gets inclusion in Google news, in the mean time keep adding more news. Untill you try you'll never know.
