Should an American get away with murder on foreign soil ?

    I prefer the civilian court sytem, as it maintains the moral high ground of the USA by giving the same trial to the accused as any American would receive.

    KSM should be tried in Manhattan. Of course, the prosecutor has the absolute discretion not to proceed with a case. They could, after getting him to a Manhattan court, decide to drop the charges and release him as a free man in Lower Manhattan.

    I think you forgot that these are terrorist against the UNITED STATES OF AMERICA. These are not killers in America or other crimes outside of the U.S.A. We would not even waster lethal injection on them.

    We are luck the founding fathers of America are not alive. They HUNG Terrorist on site once they got information. They knew that no american would have to pay taxes to a terrorist that wanted to hurt the U.S.A.

    It depends whether it really was self-defence. A proper jury would decide that. I think diplomatic immunity is silly. Some diplomats have used it to avoid the punishment of severe crimes. If I remember rightly some Russian diplomat got away with murder(s).

    Well, some of them were killers in America. What the terrorists are accused of, among other things, is the murder of civilians in New York. I believe that New York should be allowed to prosecute them in its courts for murder.

    I'm not sure that your Founding Fathers description is correct. Do you have an example of when they hanged someone accused of terrorism without a trial? I didn't even realize that terrorism was a big problem back then. I would think that more than one part of the Bill of Rights would suggest that the Founding Fathers--at least those responsible for drafting the constitutional documents which would be a basis for the United States system of government--did not hang people on sight.

    Don't know but it would be interesting to find out! While you are looking it up, why don't you see if you can find all the instances where those foreign diplomats were attacked by armed assailants on US soil. I'm very interested to see what you find!

    There were a few cases that I've read about some time ago. All of those I've seen in the USA seemed to involve a car in some way. Sometimes it was really not the diplomat's fault, i.e. he accidentally ran someone over who darted out in the middle of the road, or killed someone who was trying to jack his car. The other cases are diplomats running over people while driving recklessly or being drunk. While it may have happened in the past, I don't remember hearing about a deliberate murder committed by a foreign diplomat on US soil.

    In any case, it has now been reported that the diplomat in the Pakistani affair was actually an intelligence officer working at the embassy who was doing recon on the area when he was attacked.
    I seriously doubt this was a deliberate assassination, since the 2 men shot by the diplomat/intelligence officer were not linked to terrorism in any way, plus he actually stayed behind for a while after it happened, rather than simply shooting them and dashing away.
    Furthermore, it looks like the two men were chasing him on motorbikes after he bumped a rickshaw with his car. Probably they pulled out their guns to try to intimidate him, and he then thought they actually meant to kill him and shot them.

    After all, if you're working for an intelligence agency in a country that is experiencing issues with terrorism such as Pakistan, I'm pretty sure you would be on alert 100% of the time as you would know that some people in the country might try to kill you if they ever found out you were collecting information for the Americans.

    His identity card seized did not show him to be a diplomat but a worker on a project... later the high commission provided another identification which stated him as a diplomat. He had two identifications for a start. Then he tried to run and he was cornered by Lahore Street wardens who were there, they chased him and arrested him.

    A crime like murder or assault - no, they should be charged.

    However if you are going to move the conversation to any crimes... there are many things that are common place in one country that would be "crimes" in another.
    In New Zealand, for instance, you can't ride a motorcycle without a helmet, drive a car without a seatbelt, you can't have more than two people on a motorbike - yet overseas these things are allowed. I've seen sheep being carried on motorbikes, entire families with small babies wedged between adults. Yet activity we allow here - such as sex between two consenting but unmarried adults is a crime overseas. We don't allow a man to beat or rape his wife yet I believe in those countries where unmarried couples aren't allowed to have sex that right of a married women to say "No" doesn't exist. Odd. You can't say "Yes" and you can't say "No".

    His links to CIA and american Intelligence agencies have been ascertained, and its a threat that FBI might not kill him because he was on an overt assignment. He is not treated badly like americans have been treating in abugharib jail, he slapped a superintendent and the police man was replaced. He is being continually visited by an ambasy personnel with a women.. (may be for pleasure to calm him down)

    LMAO. Not that it has anything to do with the topic, but you say he is not being tortured because..... Pakistan has such an outstanding human rights record?

    I'd bet most of your criminals would choose the worst possible Gitmo interrogation any day over your standard police interrogation. Oh, and we don't use women as cattle to pleasure our prisoners or calm them down. Next time we need to calm a prisoner down, perhaps we can start with your daughter, sister, or mother.
