Dedi is a must for such things . And you'll need one hell of a dedi . Whit multicore and lots of RAM and tons of storage . File hosting is the 2nd most demanding activity a server can execute .
You can always start with a VPS. Any good VPS hosting provider will allow you to scale. Chances are, your site won't get much traffic for months anyway. I'd look at an off-shore host if there's a chance your site will host copyrighted files.

Thats wrong. Unless you are going to get about 100k downloads, you don't even need more than 2-3 high end servers. You can have all the servers running idle if you are going to expect a lot of traffic with huge investments. We have some 20k alexa sites running for over 2 months on just 2 server setup. Whats your budget? If you go with a host that ignore DMCA list, you will soon end up forced shutdown. Its better with a host who are tolerant for DMCA and help you resolve the issues by deleting the files or file signature.
