It is when they are being used in a Logo / Brand / Identity ... Most stock sites even have a strict usage policy in their free & extended licenses that prohibit the use of stock images in brand identities / logo's. The reason is because a brand is a unique image / Mark that represents a company / Organization / Person. Using someone elses brand image / mark or any image already in use by someone else opens yourself up to litigation (legal action - Law suits). The best practice is to create something from scratch so that you own all the rights to it & can legally sell it. Clipart / Stock is downloaded & used by millions every day, because of this, a brand image / identity could never be unique using any of it & will fall subject to legal hassles in the future. For reference you can visit any famous stock site like istock, shutterstock, etc. & read through their license agreements (Both free & Extended) which clearly state the images can not be used in a brand identity / trademark / logo. All & All it's just better to be safe than sorry & actually design your own stuff from the ground up & not use / borrow others work. And on the business owners end, it's better to be safe than sorry & brand / trademark yourself with something unique that ONLY you will own the copyrights to & not share with millions of stock downloaders.
and who said that i don't have full rights of the image????? if the contest holder want to see the rights of the image i will send it right away!
you YOURSELF said it was a stock image ALL stock images are governed under the same laws, which means as soon as someone else uses that same stock image as their brand / logo, one of them can be sued.
