Can I bring Google to small claim court?

When I opened my first account, I did make some clicks and my first account was disabled. Then I opened another account about 2 months ago. In that 2 months period, I did everything I can to promote my 3 websites and had about $500 earning (never made any clicks by myself and I did not request payment until recently).

Instead of sending my payment, Google disabled my second account.

My question is if I can bring it to small claim court for my payment because I did work on promoting adsense for 2 months. They could disable my account but not after I request payment which was 2 months after I opened and promoted it.

Any suggestions are greatly appreciated.

if you get an attorney, make sure he does not get paid unles you get paid.

No, you boke their TOS, firstly by cheating in the first place and secondly by opening another account.

 

My thought is that if I was hired for 2 months and got fired without pay right after I request my payment, I should have the right to collect my earning.

I will try everything I can to communicate with google before I bring it to the court. I hope Google consider to restate my account is a win-win for every one.

I thing google will not offer you anything as stated in their TOS i think you would have given the same address instead of a different address

That's the right attitude from google and i wouldn't send you a single penny either, no matter how much you made.
If you got banned you're not allowed to open a new account, so you broke the TOS before you even started earning.

No one can hire an attorney in small claim court. It may be a good experience to bring the big guy to the court

 

The Google ToS does not override federal, state, county, or municipal law. Basically, the ToS can say whatever it wants -- but that does not make it legally enforceable.

In small claims court, attorneys are not usually utilized. Google will, of course, use attorneys anyway. I mean, who else could they send?

You will have to file in Google's jurisdiction. i.e. you will have to travel to California to take Google to small claims court.

You were never Google's employee. You were a vendor. It's a whole different set of laws.

Your odds of winning are approximately zero, but Google certainly does deserve to be forced to deal with quite a few of their unhappy ex-publishers in court.

 

Google aren't hiring you though, there are no employees rights. You're entering into a contract with them (their contract is the TOS) if you break this contract then it also stipulates what'll happen to you. Maybe you should learn to read contracts in future.

Just handling the bureaucracy of all the cheaters, it's not worth it for them.

 

Dude, lets say you do take them to court, you will lose still because you CANT open a second account once they have disabled your account, so your at the bottom...

 

Google will send you a Pre-prepared email they send out to banned people.
And it's not a win-win.

But in his case, he doesn't even have a valid argument. He committed click fraud and then opened a fake account.
