Help Needed - They Are Taking my Domain

Discussion in 'Legal Issues' started by ridesign, Oct 4, 2010.

I had a domain dispute filled against my domain express.pk, which I have had since 2006.
The dispute was handled by: DNDRC
The company which complained has a trademark for the word "express".
I responded back in 7th June 2010, and I have received a response today, saying that I need to transfer the domain in 48 hours.
Is it allowed after so much time?

Also in the case I had stated that I have a running website and gave them details to access the additional development sections of the website, but in the case they have put:

"The disputed domain name is being used to host a parking page whereby a search engine and various links appear. However, hits to all such links/tabs results in the user being directed back to the same page hence illustrating lack of any activity on the disputed domain name."

Is there anything I can do?
    The Panel was 1 person.

If someone can help me keep my domain I can think about offering a share in the domain.

The best way to solve this problem is through ICAN.They exist to solve the legal issues with domain registrations.

I certainly would not transfer the domain.

I would bet their statement is false.

having a trademark on "express" is like saying you have a trademark on
any common word, ie: "mail" "cash" "gold" "rush"

It looks like they just want your domain. If they want your domain, let them
fight, tell them to take you to court, and that is the only way they
will get the domain, if they even get it then.

    This would be different if your domain was something like;

    UPSExpress

but with it being "express" only.

I think their claim is pretty much BS...

They are grabbing at straws in attempt to get your domain.

Do not fall for their crap.

why are you telling the op to get a lawer. If the other
side wants the domain, then they should get a lawyer, the op
should only get a lawyer if he is being sued, and then
should get a lawyer to defend the domain.

of course the OP can always consult an atty to put his mind at ease.

Express is a registered trademark here I think as we have some channels named Express News,Express Tribune,Express 24/7. I am talking about Pakistan.

Express News, Express Tribune, etc is somewhat different then the lone term "Express"

Besides according to the pk website the other party would have to pay $800US to start an arbitration.
and they would not be guarnateed to win anything. I do not think the term "express" alone in
any domain will violate any trademark, unless he used something like ExpressNEWS, ExpressTribune, etc...

They took the domain and did not take an appeal.
